This week, after lots of litigation and hard work and my client's perseverance, my client was returned his vehicle which had been seized by a police department after his arrest many months ago under Louisiana's civil forfeiture rules. The state was not able to meet its burden to convince a judge to let them keep my client's property, so it was returned to him, and it was a very good day at Tom Harang Law when he was handed his keys and drove out of a police station's parking lot in the vehicle he had lawfully purchased and owned. Having been arrested and accused of having violated the criminal law doesn't then mean we automatically also lose our rights to private property or our dignity as human beings. Unfortunately, the law allows the state to take our property from us in proceedings that are framed as "civil" ones adjacent to our criminal prosecutions. Civil forfeiture only works when people accept that the state has a right to do whatever it wants and choose not to fight back. The power of civil forfeiture lies in the intricacy of its process and the likelihood that people will, understandably, choose to lose their hard-earned property instead of fighting the state to get it back. Having a lawyer like me makes it much more likely that the state won't be successful when they try to seize your property as a part of a larger effort to take your liberty away. Don't let the state take your stuff without a fight. I can't promise you that we will win every time, in fact, I can't promise you any sort of result, but I can promise you that I will do everything in my power as a lawyer, litigator, and advocate to help you put your life back together after it is shattered by criminal prosecution.
