I often don’t comment on social media about my feelings towards people and their actions. I try to keep my feed positive and try to send positive messages out into the world. However, tonight I’ll share some thoughts that may sound harsh towards our local County Attorney’s office.

Ealrier this year a group of 20+ cyclists were safely riding their bikes in Goodyear. They were seneslelessly struck by a motorist who mowed them all down one by one killing two and severely injuring many more. From lint of first contact to the point he finally hit the brakes was approximately 600’. He was not speeding. He admitted to smoking ma*****na with his girlfriend the night before. He had 7.5ng in his bloodstream. Other states punish it as a DUI at 5ng. He lied about his steering wheel and brakes failing. Two investigations showed his vehicle in perfect mechanical working order. His failure to brake immediately, shut the car off after hitting the wall and then turn it on again and continue hitting cyclists, and on and on and on are all evidence and facts with witnesses this case had to offer. Yet our county attorney’s office declined to take the case.

It is the single biggest bicycle crash in Arizona history. To the credit of the Goodyear police department an investigation into criminal charges was promptly carried out. Upon their recommendation of the evidence they collected and submitted the driver was arrested and brought up on at least 3 felony charges. Yet nothing was happening from the county attorney.

Then yesterday the county attorney invited all the victims and their families to attend a meeting. They of course would not say what it was about. After gathering all of us in a room they proceeded with a long winded power point presentation to try and explain that inspire of the police investigation and the evidence they gathered, they felt there was not enough evidence to take the case.

The entire room was outraged. Many every victims spoke out in the meeting asking for direct answers to their direct questions. All they got was a weak and inadequate explanation of how in the opinion of the county they were not confident in the facts to proceed with the case. Like a broken record they kept repeating that never answering the questions very directly. I was in the room. I too spoke out. I too left pretty frustrated, let down, and disgusted.

As a trial lawyer I get that not every case is a slam dunk win. I get that the criminal standard of proof is higher. But I also get that the cases that go trial are the ones that aren’t a sure thing. Here the Maricopa County Attorney’s Office (MCAO) actually had a string of evidence that a jury could have in fact agreed with beyond a reasonable doubt. But the county attorney never even tried. They never even attempted to take the case.

So much more detail about this case. So much more insight could be shared to explain both sides. But that post is already too long.

So in my moment of frustration please forgive what may appear as unprofessionalism when I say this:

-MCAO severely dropped the ball. Their decision appears weak and unjustified nonnatgerbhow hard they tried to justify it.
-It feels like they are only interested in easy cases and not willing to even look at huge cases with multiple fatalities and victims if it might be too hard.
-It feels disgusting and pretty sad/shameful that our citizens in our county who depend on the State to protect them from criminal activity and serve justice when it does happen- may never be willing to even try a case if it looks like anything other than a slam dunk.
-Cyclists really do seem to face a prejudiced from our law makers, our legal justice system, certainly motorists, and even sometimes law enforcement (although not in this case!).

The Maricopa County Attorney's Office has announced charges have not been brought against Pedro Quintana-Lujan and is instead referring the case back to the City of Goodyear.

Fall Tour de St George. What a beautiful weekend to race bikes. Erik Huso, Jaime Waldemar Cancel, Vanderwalker and I all drive up to St George for the Tour. We were able
To meet up and ride with several of our BAA Racing Utah teammates as well, I’ll try to name them all if I can remember: Kelly Lund, Ethan Fisher, Jenna, David Dodge, Justin Mason, and Russell Mason. So fun to race with them. Sounds like everyone did really really well.

Justin and Russell Mason, raced the 100 mile course and crushed it. Justin got 2nd in his age group and 29th over all. Jaime and Matt ended up racing the 100 mile course as well since the turns weren’t very well marked. 😂😂😂 Even after a couple of flats they still came in right about the 5 hour mark including over 6,000’ of gain. Solid!

The rest of us raced the 85 mile course with about 5,000’ of gain. As always this part of the world is a beautiful place to race bikes. Both the 85 and 100 mile riders started together. We rolled together until about mile 20 before the course split. Ethan, Kelly, Jenna, Erik and I were all in the lead group. It was fairly small at the course split, I think many riders missed it. We took advantage and just kept on riding.

At about mile there was an air station that many riders stopped tk fill up bottles. Erik and I decided that because we at much heavier cyclists and slower climbers we would keep rolling over to and up the big climb to give our selves a better chance of hanging on to the lead group. Once we were on the climb we decided to push it a bit and try and put some time into the rest of the group and give ourselves a better chance. Once we made it to the top and we were still leading the race with our little 2 man breakaway- we just kept our heads down and kept pushing all the way to the finish line. We were able to hold off the chasers and we finished 1st and 2nd!!! Was pretty cool to work together and accomplish that result.
