The minimum wage in Arizona just increased to $15.15 from $14.70. What does this have to do with divorce? It impacts both child support and spousal maintenance calculations. Child support in Arizona is calculated using a formula and one of the figures going into this formula is a parent's income. If a parent is unemployed, or is not working at full potential, the Court generally presumes that parent is capable of full-time employment of at least minimum wage. Similarly, once it is determined someone qualifies to receive spousal maintenance, Arizona has a formula for calculating the range of support to which one would normally be entitled. The increase in minimum wage would change the total amount of money to be paid/received under both calculations. Of course, if someone is actually capable of earning more than minimum wage, that realistic figure might be used by the Court instead. But minimum wage is generally used as the bare minimum for these calculations.

It may be appropriate in limited circumstances, such as a short marriage, no children, and few or uncomplicated assets. However, the court system expects individuals to understand and follow the law, even when representing themselves. Mistakes can be expensive to correct, if they can be corrected at all. Failure to properly disclose assets or fully understand the legal and financial implications of dividing property—particularly retirement and investment accounts—can result in unintended tax consequences or long-term financial losses that exceed the cost of consulting with a professional.
