This is a claim we see often with custody cases in family court. A child is acting up in your home, but it’s the other parent’s fault. The thing is, it could actually be true, but you can guarantee the other parent is going to point out that the behavior is happening in your home and not theirs. So that means you have to find a way to show the connection between the cause and effect. Sometimes it exists, and you just have to find the proof. Sometimes it doesn’t exist at all and someone is just full of it. Careful documentation can help make the pattern more clear, but every case is unique so the evidence that is necessary, can vary from one case to another.

Arizona deals with the cost of insurance for children similar to the way it deals with childcare expenses as they both relate to child support. However, childcare expenses are usually pretty easy to quantify, while health insurance can often be tricky because many policies include people who are not part part of the child support order.

Parents are always in control of their own parenting plan. That means you can make changes as needed as long as both parents agree. Those changes could be a one time change to accommodate something that came up, or it could be a long-term modification. Sometimes people feel like they are required to follow their parenting plan exactly and that they have to go back to court for any changes whatsoever, but the parenting plan is a default schedule, and parents always have the ability to make changes as long as both agree. I usually advise people to make sure any changes are in writing, and if the changes significant enough, then you may want to consider filing something with the court to make it official, but it is often not necessary.

How much debt does a person need to have to qualify for bankruptcy? Well, this is a bit of a trick question because it is entirely up to the person filing.

There are negative consequences for bankruptcy, so that prevents people from filing frivolously. Also, my experience has shown that most people try everything they can to pay off their debts and only use bankruptcy as a last option.

What I find most of the time, is people look for bankruptcy help when their debt is insurmountable based on their individual circumstances.
