On April 7, 2026, 25-year-old Brian José Morales García was riding to work with his construction crew near Fredericksburg, Texas, when police stopped the vehicle and called immigration authorities.

Brian told them he was born in Denver. He told them he was an American citizen. He told them he had a birth certificate and Social Security card at home. According to Brian, agents mocked him, ignored him across five days and five facilities, pressured him to sign voluntary departure papers, and threatened him with prison. Then they deported him to Mexico.

DHS declared that “Bryan Jose Morales-Garcia” was unlawfully present and had admitted being Mexican. The problem was inconvenient as hell: Brian was telling the truth. He is a dual U.S.-Mexican citizen.

For nearly five months, Brian was stranded in Mexico, separated from his pregnant wife, unable to work, while attorney Kate Lincoln-Goldfinch assembled the absurd mountain of evidence required to prove something the government should have established before throwing a human being across an international border. Birth certificate. Social Security records. Denver hospital records. Witness affidavits. Certified Colorado records. She sued DHS, CBP, the Texas Department of Public Safety, and the Gillespie County Sheriff’s Office.

Last week, the Justice Department finally reached an agreement allowing Brian to return while his civil-rights lawsuit proceeds.

On Sunday, August 30, Lincoln-Goldfinch drove to Laredo and brought home the citizen his own government had expelled.

Do not let anyone dismiss this as one unfortunate clerical mistake. These are not harmless paperwork errors. These are human beings losing months and years of their lives because the government gave itself enormous power over people and then couldn’t be bothered to make damn sure it had the right people.

After Brian crossed the bridge at Laredo, he climbed into a car with his lawyer and headed north. At the first immigration checkpoint, a CBP officer leaned toward the window and asked, “Are you all American citizens?” Everyone answered together: “Yes, sir.” The officer waved them through.

Brian did not become an American citizen when the Justice Department finally allowed him home. Kate Lincoln-Goldfinch did not magically turn him into one by producing enough paperwork to choke a federal courthouse.

Brian Morales was an American citizen when police stopped him. He was an American citizen when agents mocked him. He was an American citizen when they threatened him. He was an American citizen when they deported him. And every single day the government kept him out of his own country, he was an American citizen.

He always was.
