Jake is passionate about Constitutional Law and Civil Rights, and he brings that drive to The McDaniel Law Firm and to the Memphis community as a whole.

Tennessee’s New Hands Free Law

Public Chapter 412 prohibits drivers of all vehicles from holding their phone (a handheld electronic device) while their vehicle is in motion. The law, which goes into effect on July 1, includes the following:

A driver cannot hold a phone in their hand or use any part of their body to support their phone, while their vehicle is in motion. Driver can only use their phones to make or receive phone calls by using a speakerphone, an earpiece, a wireless headphone, or a phone that is connected to the vehicle or an electronic watch. GPS navigation devices are allowed.
There is a “one tap” provision allowing one tap or swipe if it is mounted, but cannot hold in your hand.

A new law went into effect January 1, 2018 that could impact anyone who drives through active school zones in Tennessee.

The law states that it is a Class C misdemeanor, punishable by a fine of up to $50, for a person to knowingly operate a motor vehicle and talk on a hand-held mobile telephone while the vehicle is in motion in any marked school zone in the State of Tennessee when a warning flasher or flashers are in operation. However, if the driver is 18 or older, and the telephone is equipped with a hands-free device, it will not be considered an offense. Drivers under the age of 18, or who possess a permit or intermediate license, will be considered breaking the law if they are talking either using a hands-free or handheld device while driving. Remember that texting while operating a motor vehicle is illegal in Tennessee.

Trial Court's decision to deny judicial diversion on two counts of Reckless Vehicular Homicide is reversed by Appeals Court

Mark S. McDaniel and Kevin G. Patterson, Attorneys for Sherry Claffey, successfully appealed and obtained the reversal of a trial court's denial of their client's application for judicial diversion on two counts of Reckless Vehicular Homicide. Judicial diversion allows certain first time offenders to have their sentences deferred, and after a period of time, obtain the dismissal of their charges as well as expunction of their public record.

The panel of three appellate judges all agreed that the trial judge abused his discretion when he denied their client's request for deferral of sentencing. The appellate court ordered that their client be placed on judicial diversion for five years. The appellate court further ordered that her driver's license, which the trial court had revoked for five years, be reinstated. The opinion of the Tennessee Court of Criminal Appeals, filed December 14, 2016, is attached:

New Law Re: Texting and Driving
Previous Tennessee law considered texting while driving as a non-moving violation. As of July 1, 2016, a new law now states that texting while driving constitutes a moving violation so a conviction will add points to your driving record and your insurance rates may be impacted. The new law also mandates a driver education course on the 1st offense. Be wise - Don't text and drive

After I was told by 2 other attorneys that there was nothing they could do for me, I prayed, found him under local site, and he delivered! I fell ill on the Dec.1st 2015, missing a traffic ticket court date. And searched around because I could not afford to accept guilty 4 a speeding ticket& have my insurance sky rocket an extra $200 per month.. Other lawyers said once it's hit near 30 days, I'm out of luck even if I had reasonable cause/ hospitalization docs. But attorney McDaniel said, not to worry because he'd have them re-open and dismiss. And that's exactly what happened! Thanks attorney McDaniel!

The Law Office of Mark S.McDaniel is located at 243 Exchange Avenue in Memphis, Tennessee. This single story "shotgun style" house was built in the late 1800's. It has many antique architectural details including beautiful pocket doors and transom windows. This building has survived floods like the one in 1912 (pictured below). A 1930 Census of the area shows a Jewish immigrant family from Latvia lived in the house at that time (building was #239 in 1930). A member of this family brought us family photos including one of him and his siblings on the front porch. Attorney Mark McDaniel bought the building in 1988 and continues to provide legal services to the Mid-South area. Can police now confiscate my vehicle if I don't have proof of liability insurance?

Many of you have read or seen news reports of the amended auto liability insurance law (aka financial responsibility law) that went into effect July 1, 2015. One aspect of this law that affects all drivers is that drivers will be required to show proof of insurance before they can get their vehicle registration renewed. Tennessee law already requires the operator of a motor vehicle (not necessarily the owner) to provide proof of liability insurance currently in effect when requested by a law enforcement officer. Failure to provide such proof can result in a fine and loss of driving privilege. Under the new law, repeat offenders are now subject to increased penalties including fines up to $300, as well as confiscation and potential forfeiture of the motor vehicle to the State of Tennessee. As with all new laws providing for possible forfeiture of property, it will take some time for the local jurisdictions to define and implement their policies. This law targets repeat offenders that persist in driving uninsured. So, if you are not a repeated offender, the answer to the above question is no. If you are a repeat offender and like your car, you will need legal help, so give me a call.
