A Kentucky lawyer who says he is working as a paralegal at the law firm carrying his name claims to be retired, rather than suspended, which means that the Kentucky Bar Association has no authority to hold him in contempt for allegedly practicing law.

I remember as a young lawyer reading a case in which the court said the conduct “was not a textbook example of good management, but not illegal.” I suspect that a court would agree with the first part of that sentiment about an owner that points a gun at workers who have asked for water. Fortunately, for the workers (a) no one was shot and (b) this conduct is actually illegal. It’s important to know your rights, but it’s also important to understand that while an employer has a lot of authority, there are limits.
