There is something a lot of people don't understand. The role of a Notary is limited. Even though we're an Official Witness, unless there's a law, court ruling, or state attorney general opinion that says otherwise, we can only officially witness the signing of documents, along with administering oaths or affirmations. In a few states, we can officiate weddings or certify copies. That's all.

Everything else that notaries are asked to do is beyond our official capacity. That does not mean we cannot do these extra things. It just means we aren't doing them as notaries and we need to research whether they are legally allowed for everyone to do, as some things are restricted as to who can do them.

In Tennessee, we're authorized to officiate weddings. And there are no restrictions on the duties normally assigned to a Signing Agent, so we can be NSAs here as long as we're aware of the risks involved.

We are not specifically authorized to certify copies and I found 2 TN AG opinions on this subject that leave it a bit muddled as to whether we have this authority under common law. My best guess is we can certify copies if we are the keeper of the original and make the copy, but not otherwise. We can notarize a statement by the holder of the document that they made the copy, if that helps.

Interest rates just went up again today. That means refinancing (which is already down 70% or more from last year) will stay low. Inflation and other factors have pumped the sales prices of homes way past where most people can afford them. Major lenders are laying off people by the thousands. And all those extra new notaries who joined the industry during the boom time of the pandemic are still here.

This is NOT a good time to become a new NSA. Unless you have a background in a relevant field and can use that to network your way to business, you're unlikely to see a return on your investment in supplies and credentials and training for a year or two.

For those thinking about becoming an NSA, please consider your startup costs as part of your planning.

Startup costs are more than just the training or certifications for the NNA and N2P.

You also need listings on the big 3 sites (signingagent -- that's the NNA site for NSAs; notaryrotary; and notarycafe).

Some folks also suggest 123notary. I stopped recommending them because the owner is a racist & because he calls up notaries (who paid for listings on his site) at odd hours and demands that they stop what they're doing and politely answer his pop quiz. Some of his questions are based on laws in his state, not the state where the notary lives. Some are apparently based on things he posted on his site, which are not laws or state rules. If they fail to do as he wants or to pass, he drops them. I can't support that sort of behavior, even if it means less income to skip his site.

Other startup costs include a scanner/fax/multifunction laser printer which can print letter and legal and scan both; cell phone with unlimited data; good car (unless you're in NYC, which apparently has good mass transit); notary E&O insurance (at least 25K and some title companies require 100K); paper; toner; gas; auto insurance; software to encrypt scans ; one of the ID checking guides; some sort of bookkeeping software; a bag to carry your notary supplies in; another bag to carry documents in; and any memberships you find useful for your business (NNA, NR, NC, AAN, ASN, NLI, BBB, CoC, etc).

Also you may want signing agent insurance, a business rider on your home & auto insurance, and/or general liability or professional insurance.

And I'm sure that I'm missing some costs.

Only a few states require any training or an exam to become a notary. It's left up to the notary to find out what they need to know.

This is why I laugh at people getting puffed up about the notary "profession." There is no profession where you can get in without a test to be sure you know what you're doing. We aren't professionals in the usual sense of the word, not just by getting a notary commission.

We can *become* professional service providers by learning everything there is to know about our role, responsibilities, authority, and limitations -- then using that knowledge in a proper manner. A professional notary lives their commitment to serve their community by doing more than what the state requires; their dedication shows by how much of themselves they invest in being the best notary possible.

If you haven't taken any classes on notary basics, have not read any books on the same, have not watched a bunch of YouTube videos on this, you really have no business notarizing anything. This is serious stuff we're involved with. Treat it seriously or stay home.

News! Laura Vestanen has a new book out called _Notary Marketing_. It's an ebook only and only available for the Kindle as far as I can tell. It was just published in January 2019, so I'm guessing it is updated from the info in her previous book, which I've recommended many times here on Facebook. And it's only $9.80, which is less than 1/2 what that earlier book on paper cost.

You know people have not read your business page at all when they text you during a time when your site (and everywhere else that you appear online) says you are closed to ask if you are available now -- and they want you to go to another state when your site says you are only commissioned in one state.

Seriously, folks! My Google business page, my Yelp business page, and all the other sites where my business is posted have my hours listed for a reason. And my website clearly says I cover west Tennessee only, not MS or AR. How hard is it to look before wasting your time and mine?

(And, of course, I did not get the text until I was at work, where I get very poor to no cell phone signal, so it was hours later before I could respond.)
