🏠 TITLE TIP: What Happens After Closing?

An “as-is” or present-condition provision can significantly affect a buyer’s ability to pursue claims for property defects discovered after closing—but it does not necessarily mean the seller is protected from every post-closing claim.

The important part? Understand the contractual allocation of risk before the closing table. Once the transaction has closed, the options available to a buyer may be very different from the remedies that were available before closing and importantly before the end of due diligence contingencies.

For REALTORS® and their clients, this is one more reason to carefully review the contract, disclosures, inspection issues, and any negotiated provisions before closing day.
