The most common question about divorces, I get after our initial interview and goal setting, is how do we start tge process, my answer is always the same: gathering your financial information for the previous 3 years including a financial statement. This is the first requirement put in place in court. Taking the pressure off of yourself by doing it prior to filing makes a big difference!

Since this recently came up, I thought I should address it to you all. Despite what clients may request in an “amicable” divorce, an attorney cannot represent both parties in a divorce proceeding. The Attorney has a primary duty to their client.

U.S. District Court says in the case of Martin, et al. v. Gross, Civil Action No. 16-11362-PBS (D. Mass. Dec. 10, 2018) that the Massachusetts wiretapping statute, G.L.c. 272 sec. 99’s prohibition of “secret recordings” of police or government officials (performing their duty in public spaces) is not Constitutional under the First Amendment. Open and obvious recording of anyone is not violative of the statute because it lacks the “secret” portion of the prohibition.

Most divorce actions end with the signing of a separation agreement that is approved by the Judge. It is vital to know what you are agreeing to and that the terms are ones you can fulfill.

What happens if you don't meet a deadline or make a payment required under the settlement agreement?

In Massachusetts a civil contempt may be won by your former spouse, if they can show: 1) by clear and convincing evidence that you disobeyed a clear and unequivocal command of the court and 2) that you have the ability to effect that order.

In other words if you were ordered to make a $10,000 payment by 1/15 and failed to do so AND had the funds available either in assets or in income, you will find yourself held in contempt. Not only will you be required to make the payment along with interest at 12%, you will be subject to paying your spouses attorney's fees determined by the judge or through agreement.

Assuming a 10K payment is due and you fail to pay it for one year, you would owe $11,200 at the end of 12 months. Additionally, attorney's fees could be anywhere from $1000 to $20,000 or more!

I have prosecuted and defended contempt actions, they can have far reaching consequences beyond money, they can also result in jail time if the judge so orders. No matter which side of the v you find yourself in a contempt issue, hire a knowledgeable attorney to help you.
