Do you need testing data before filing a patent?
Not always. But testing can be particularly important for biotechnology, pharmaceutical, and other inventions where the relationship between structure and function may be difficult to predict.
Testing data can help establish utility, support broader genus claims, support a claimed therapeutic or functional result, and demonstrate unexpected or superior results over the prior art.
The key is having the right data to support the invention and the scope of protection being sought.
