On April 8, a parking garage under construction in Philadelphia collapsed, resulting in the tragic loss of three construction workers. This incident has sparked questions from my non-lawyer friends about the legal response and the parties involved in potential litigation.

The question of who is ultimately responsible is complex and requires careful consideration. Determining fault and ensuring fair compensation for the families involved will take time and effort.

While it might seem logical to hold the employer accountable, Pennsylvania’s Workers’ Compensation Act generally limits the employer’s liability to workers’ compensation benefits, even in cases of death. In fact, the employer can even assert a subrogation lien against any recovery from a third party.

Victory in PFA Court
