Corales & Woody, LLC is now Corales Law, LLC! After 12 years of partnership with one of the best in the business, my best friend Nathan Woody, the tides have told us it's time to change things up. I will continue my mission to zealously represent those accused of crimes all across the State of Georgia. Jobs that put workers in extreme danger often involve "hazard pay", an increase in hourly rate intended to compensate the worker for assuming risk of serious injury. Additionally, the Employer will have to pay higher workers' compensation premiums because of the higher likelihood of a significant insurance claim. So, for high crane operators, tree climbers, powerline workers, commercial window washers, roofers, etc. it becomes especially important to educate yourself on state reporting procedures for work injuries. One unfortunate side effect of the COVID-19 pandemic has been that defendants in criminal cases are remaining incarcerated for longer periods of time awaiting determination of bond prior to trial. This article discusses an effort by criminal defense lawyers to preserve the liberty of individuals who are presumed innocent until proven otherwise.

In theory, these are potential Workers' Compensation cases. Obviously we will have to wait and see how the courts address the COVID-19 cases in the future. But, for argument sake, two big "IF" questions will be:

1) Can you establish that the exposure to COVID-19 happened at work? (and not elsewhere); and

2) Will the medical evidence (doctors) conclude the COVID was, in turn, the cause of death (and not something else)?

As a matter of public policy, Workers' Compensation relief for COVID-19 injuries or death, particularly for our medical and "frontline" workers, would seem desirable for our society. However, as always, the desire to protect these workers will be balanced against company-side concerns regarding costs and practical application.

We will continue to monitor the COVID-19 situation as these will be new cases for Workers' Compensation courts.
