Probate is the legal process of settling an estate—where the court, among other things, approves and admits the will into probate (if there is one); appoints a personal representative; and oversees the personal representative's settlement of debts and distribution of assets on behalf of the estate. The probate process can mean: added paperwork through required court filings, including the filing of financial accountings through inventories and annual returns; ongoing court involvement and awaiting court approval; and additional delays and stress at the worst possible moment. These are just some of the very valid reasons that people choose to create a Trust, which avoids the probate process and can keep financial and other related estate matters private and off the court docket. 🏛️📑
