Our Family Law Firm is located in Marietta Georgia and we have been a part of the local community for over a decade. Our guiding principles are strong advocacy without adding to the devastation that is inherent in domestic issues. Our goal is to protect clients from this devastation as much as possible and allow them to begin th

eir new life’s while ensuring that they receive the strongest representation possible. We strive to provide this representation to all of Atlanta. Family Law and domestic relations is a broad category of law dealing with a multitude of issues and litigation. This does include divorce; however, it also includes issues before and after divorce and many that are not the result of divorce. These issues may include a prenuptial or post-nuptial agreement for individuals concerned with protecting their assets during a possible divorce; issues of contempt to enforce orders of the court not being followed by one or both of the parties; modifications of orders dealing with custody visitation and/or support both child support and spousal alimony; issues of paternity and custody necessary to determine the biological parent and the support obligations that are inherent in this action; adoptions whether consensual or not, which can be brought by a relative; guardianships and power of attorneys, necessary for temporary arrangements; protective orders necessary as the result of domestic violence; juvenile matters of dependency and deprivation, which can be private actions or actions initiated by the state through the Department of Family and Children Services (DFCS); and legitimation actions with all of the issues of visitation, custody and support necessary for preserving the legal rights of fathers. Family Law and domestic relations are the most intimate, emotional and demanding practice of law in all legal specialties. There is no other field of law that requires such a broad range of expertise on multiple issues that so dramatically affect a client on a personal level. This is not litigation over money owed, contracts breached or damage suffered as the result of an accident, this is litigation to end a marriage, decide the fate of children and assist in the financial well-being of all parties in the future. This is personal law and law that has an immediate and direct effect on people and children’s lives. It is essential that when hiring a family law attorney, you find someone who has the knowledge and experience to handle all of the issues above and make those issues a reality in the courtroom. We offer the following services:
Divorce
Legitimation and Paternity
Visitation and Child Custody
Alimony and Child Support
Contempt
Modifications of Divorce Decrees
Temporary Restraining Orders
Adoption Law

Many divorce law and family law offices will promise strong advocacy and caring representation but not many law offices will commit to representing you for a fixed flat rate– this office will. For years this office has represented clients in all of the Metro Atlanta counties and with offices in Marietta and Midtown Atlanta, we have regularly represented clients in Cobb, Cherokee, Paulding, Fulton, Dekalb, Gwinnett, Clayton, Forsyth, Henry, and Bartow counties. And, regardless of what court we go to one thing remains constant, our clients have never been forced into bankruptcy to pay for the representation they need. An experienced family law attorney understands your particular situation and more importantly has a strong idea of the eventual outcome and how to get there. As a result, an attorney with this knowledge can work with a budget that is realistic and not one that promotes endless litigation and destructive costs. Your domestic matter, whether it be a divorce, child support or a custody modification dispute does not have to leave you with the extra burden of financial ruin. We offer the Flat Fee System for all services. Learn about the fields of law in which we specialize.

Who Gets to Stay in the House During a Divorce?

The person who remains in the marital home after a separation does not automatically become the person who receives it in the divorce.

Several issues may need to be considered, including:
• Who legally owns the property
• Whether the home was purchased during the marriage
• Who is paying the mortgage and household expenses
• Whether children are living in the home
• Whether either spouse can afford to keep the property
• Whether a temporary court order addresses possession of the home

Moving out also does not automatically mean giving up your ownership interest. However, leaving may create new questions about parenting routines, bills, personal belongings, and temporary living arrangements.

Before deciding to leave the home or asking your spouse to move out, it is important to understand the possible legal and practical consequences.

Attorney Sean R. Whitworth represents clients facing divorce and property-related family law matters throughout Marietta, Cobb County, and the greater Atlanta area.

What Should You Have Ready Before Speaking With a Family Law Attorney?

You do not need to arrive with a perfectly organized file or every answer already figured out.

However, gathering a few basic details can help an attorney better understand your situation:

• Important dates or upcoming deadlines

• Existing court orders or legal documents

• A general overview of income, property, accounts, and debts

• Information about current parenting arrangements

• The questions or concerns that feel most urgent

Do not postpone seeking guidance because you are missing a document or unsure where to start. The purpose of the first conversation is to understand the situation, identify the issues that may require attention, and determine the appropriate next steps.

Attorney Sean R. Whitworth has nearly two decades of experience representing clients in divorce, custody, child support, alimony, and other Georgia family law matters.

When emotions are high, conversations about children, finances, or the family home can quickly become confusing or confrontational.

Communicating by text or email may create a clearer record of what was discussed, particularly when the conversation involves:

• Parenting schedules

• School or medical decisions

• Household expenses

• Access to personal property

• Temporary agreements

Written communication should still remain brief, respectful, and focused on the issue. Avoid insults, threats, or messages sent in the heat of the moment. Before pressing send, consider how the message could appear if it were later reviewed by an attorney or the court.

The appropriate approach depends on the relationship and the circumstances of the case.

With nearly two decades of family law experience, Attorney Sean R. Whitworth represents clients throughout Marietta, Cobb County, and the greater Atlanta area.

Thinking About Moving Out Before Divorce? Consider This First ⬇️

When tensions are high, leaving the marital home may seem like the easiest way to create some distance. But before packing your belongings, it is important to consider how the decision could affect your day-to-day life and the divorce process.

Moving out does not automatically mean that you lose your ownership interest in the home. However, it may create new questions:

-Who will continue paying the mortgage and household expenses?

-Where will the children stay?

-Will a temporary parenting schedule be needed?

-How will access to personal belongings be handled?

The right decision depends on your safety, finances, family circumstances, and legal situation. Before making a major change, getting legal guidance can help you understand the possible consequences and prepare for what comes next.

Decisions Made Early in a Family Law Case Can Matter Later

Moving out, sending an emotional message, changing access to an account, or agreeing to an informal schedule may seem temporary. Depending on the circumstances, however, those choices could become relevant later in the case.

Getting legal guidance early can help you better understand your options before taking a step that may be difficult to reverse.

Can One Spouse Empty a Joint Bank Account Before Divorce?

Having access to a joint bank account does not necessarily mean withdrawing all the money is the right decision.

During a Georgia divorce, large withdrawals, transfers, or unusual spending may be reviewed when marital property and financial responsibilities are addressed. Emptying an account can also create immediate problems if those funds are needed for household expenses, housing, or the children.

There may be valid reasons to protect access to money, but the best next step depends on the specific circumstances. Before moving a significant amount of money, closing an account, or changing access, speak with an experienced family law attorney about how to protect yourself without creating additional complications.

Divorce decisions aren’t always as black and white as they appear.

Sometimes people file and later decide they want to try again. Sometimes circumstances change. Sometimes both spouses simply realize they aren’t ready to move forward.

But once a divorce case has been filed, changing your mind doesn’t necessarily mean you should just ignore the case or assume everything stops automatically.

What happens next depends on the circumstances and where you are in the legal process.
If your situation has changed after filing, get accurate information about what needs to happen next.

Attorney Sean Whitworth represents individuals and families throughout Marietta, Cobb County, and the greater Atlanta area in divorce and family law matters.

-Who is going to be responsible for the credit cards?
-What about the mortgage?
-And what happens to debt that’s only in one spouse’s name?

Financial questions during divorce go far beyond deciding who keeps what. Debts and financial obligations can also become an important part of the process, and the answer isn’t always as simple as whose name appears on the account.

If divorce is on the horizon, understanding the full financial picture before making major decisions matters.

➡️ If You’re Thinking About Divorce, Start With Information, Not Assumptions.

One of the most helpful things you can do before filing for divorce has nothing to do with going to court ⚖️

It’s getting organized.

Understanding your income, assets, debts, childcare expenses, retirement accounts, and other financial information can make the process less overwhelming and help you make informed decisions moving forward.

You don’t need to have everything figured out before speaking with an attorney, but having a clearer picture of your situation is often the best place to begin.

Attorney Sean Whitworth has helped families throughout Marietta, Cobb County, and the greater Atlanta 📍 area navigate divorce with practical guidance for nearly two decades.
