David Haskin and Attorney Austin Perry recently settled another Dram Shop Case against a now defunct bar in Clayton County Georgia. Georgia’s Dram Shop statute allows an innocent party who is injured by an intoxicated driver to sue a bar or others who furnish alcohol: (1) where alcoholic beverages are provided to a person who is not of the lawful drinking age with knowledge that the underage drinker will soon be driving a motor vehicle; or (2) where alcoholic beverages are sold or furnished to a person who is in a “state of noticeable intoxication” with knowledge that person will soon be driving a motor vehicle. O.C.G.A. § 51-1-40(b).
Dram shop lawsuits are filed against restaurants, bars and nightclubs or other commercial establishments that sell alcohol.
Dram shop cases are notoriously difficult because PROOF that a person was noticeably intoxicated and provided alcohol along with demonstrating that the provider had knowledge that the person would soon be driving can be tough to uncover. Insurers are more likely to fight a Dram Shop Case and win due to this more difficult burden. After all, the intoxicated driver who caused the injury bears a great deal of responsibility in causing the injuries. For this reason, a driver can’t sue those who furnish alcohol if he injures himself or his immediate family members.
In this case, we were able to convince the Insurer that the bar they insured bore some responsibility for the crash that killed our client’s son. Why?
We showed that the patron – later the driver - was served a drink that was advertised as having 7 different shots of alcohol. There was evidence of his intoxication subsequent to him consuming at least some of this drink and others. He then ordered and was served after showing signs of being drunk. We hired an expert to help us prove that the driver more likely than not was intoxicated at the bar we were suing. We presented evidence that the establishment knew or should have known that he would soon be driving.
Our client will never be made whole for her losses in this case and no amount of money could make this right. The driver went to jail for his actions in this case and only had $100,000 in insurance coverage. Pursing Dram Shop actions allowed us to recover far in excess of that amount for our client.
