Georgia homeowners: new rules just changed how your home can pass to your loved ones.
House Bill 413 updated Georgia’s Transfer-on-Death Deed (TODD) law in 2026. A TODD lets you name beneficiaries for your real estate so it may pass outside of traditional probate—while you keep full control during your lifetime.
Key points to know:
• The basic idea stays the same: you keep ownership and control while you’re alive.
• You can now name alternate beneficiaries and even a trustee of an existing trust.
• Any mortgage or lien still stays with the property.
• Crucial: for owners who pass on or after July 1, 2026, beneficiaries generally have 9 months to record the required documents or the property may revert to the estate.
