This Memorial Day, we pause to remember the men and women who gave everything in service to our country. Their sacrifice is the reason we can gather with family, fire up the grill, and enjoy the freedoms we so often take for granted.

From all of us at the Law Office of Austin Nelson, thank you to the fallen — and to the families who carry their memory.

If your weekend includes a cookout or a cold one, please plan a safe ride home. Cobb County sees extra patrols and DUI checkpoints over the holiday, and one good decision can protect your weekend and everyone else's. Celebrate well, get home safe, and honor the day.

New on the blog.

We're kicking off a Q&A series answering the questions people ask most when they're dealing with the courts for the first time.

We're starting with a big one: What is an arraignment?

If you have a court date coming up and that word has you worried, take a breath. An arraignment isn't a trial. Nobody decides if you're guilty. The judge tells you your charges, and you say how you want to plead — often in just a few minutes.

We explain exactly what to expect, your plea options in Georgia, and the one deadline you don't want to miss. Read it here https://austinnelsonlaw.com/blog

Cannabis sativa is both illegal and legal in Georgia. Should the "odor of ma*****na" still be probable cause?

That’s not ma*****na you smell officer, it is Cannabis. But who cares what we call that "green, leafy substance"? As a criminal defense attorney that believes our Fourth Amendment rights should still mean something, I do. The “odor of ma*****na” is used as probable cause for all manners of sea...

It's more than just making sure you keep it between the navigation beacons - boating under the influence in Georgia can land you in hot water

Georgia takes boating under the influence on the waters of our state seriously.

- It is illegal to operate a vessel with an alcohol concentration of over .08 or to have an alcohol concentration of .08 within 3 hours of operating any vessel
- It is also illegal to operate a boat under the influence of alcohol or drugs to the extent that it is "less safe" to do so - this includes legally prescribed drugs and alcohol concentrations of less than a .08 if you are deemed less safe to be operation of a vessel
- A conviction can result in up to 12 months jail, a fine and community service
- Refusal to submit to a breath or blood test can result in a 12-month suspension of your boating privileges

If you have been accused of operating a vessel under the influence, call me for a free consultation 404-904-6704.
