Dividing retirement and investment accounts in a Georgia divorce is more straightforward than most people think.

Georgia isn't ruled by title. Just because an account is in your name doesn't mean it's all yours. Contributions made during the marriage (including employer matches) are marital assets subject to equitable division. And no, you won't face early withdrawal penalties when your retirement account gets divided.

When an account needs to be divided, the court issues a Qualified Domestic Relations Order (QDRO), which instructs the account provider to split the account directly. It's one of the most emotionally charged questions in a Georgia divorce - who keeps the ring?

In Georgia, an engagement ring is considered a gift given in contemplation of marriage. Once the marriage happens, the recipient has earned it. That means the person who proposed generally doesn't get it back, even if it was a family heirloom or cost a small fortune.

The only way to get that ring back is if the other spouse agrees to return it. Otherwise, Georgia law treats it as separate property belonging to the recipient.
