Divorce gets expensive when vague agreements turn into a lot of back and forth.

Say you and your spouse agree to sell the house. Sounds simple. But what if it doesn't sell? Do you reduce the price? Who covers the mortgage while it's listed? What about repairs? What if one of you wants to buy the other out instead?

Every unanswered question means another conversation, another email, another round of revisions. The more you work through upfront, the less time you spend with a professional reaching a final agreement.

A cheap uncontested divorce can become very expensive if the paperwork isn’t actually protecting you. Before choosing a rock-bottom flat-fee service, ask what you’re really getting. Will an attorney actually review your agreement, explain the legal consequences, point out potential problems, and suggest language that better protects you? And how often are clients actually able to finalize their divorce using the documents provided? Keeping divorce costs reasonable is a great goal. But saving money upfront isn’t a bargain if mistakes in the agreement create much bigger problems later.

A low-conflict divorce lawyer is not a passive divorce lawyer. Good lawyers know when to push, when to respond briefly, and when engaging will only create more conflict and more legal fees. And if your divorce is moving slowly, that doesn’t necessarily mean your lawyer isn’t doing enough—sometimes there are parts of the process no attorney can speed up. The goal isn’t to make the most noise. It’s to protect what matters, avoid unnecessary fights, and get you through divorce as efficiently and peacefully as possible.

Uncontested divorce and mediation are not the same thing.

An uncontested divorce means you've already reached a specific agreement on every issue: the custody schedule, who keeps which asset, how debt is divided, the child support amount, and more. At that point, the next step is putting the agreement in writing so you can file.

Mediation is often how couples get there. If a few decisions still need to be made, or you're stuck on a couple of issues, a mediator guides the conversation and helps you explore options until you reach a full, final agreement.

An uncontested divorce is the result. Mediation is one way to get to it.

Agreeing to get divorced is not the same as having a divorce agreement.

"We agree on everything" is a hopeful place to start. It's also where a lot of couples stop, before the real details are worked out. Who keeps the house. When someone moves out. How a name comes off the mortgage. What happens if a refinance isn't possible right away.

Naming these early doesn't make your divorce less peaceful. It's what keeps it peaceful, because it removes the surprises later.

You can agree to get divorced and still not have a divorce agreement.

This is one of the most common things I see. A couple comes in, says "we're on the same page, we agree on everything." That's a great start. But what does everything actually mean?

Have you agreed on who keeps the house? When the other person moves out? How you get one name off the mortgage? What happens if a refinance isn't possible right away?

Wanting a simple, peaceful divorce is not the problem. That is the best place to start. The problem is assuming you're ready to file before the details of a settlement are worked out.
