When Does Child Support End in Texas?

A question we get a lot: "So... when does this actually end?"

In most Texas cases, child support continues until the child turns 18 or graduates high school β€” whichever happens later.

There are exceptions: support can extend indefinitely for a child with a disability, and it can end earlier in certain circumstances, like marriage or emancipation.

One thing that surprises people: turning 18 during the school year doesn't automatically end support if the child is still in high school. The order keeps running until graduation.

What Is Mediation?

Mediation isn't a courtroom showdown β€” it's a conversation.

A neutral, trained mediator helps you and your ex work through custody, support, and property decisions together, instead of leaving them up to a judge who's never met your family.

It's often faster, more private, and gives both sides a real voice in the outcome.

When Support Isn't Being Paid, You Have Options

If you're the parent waiting on support that isn't showing up, we want you to know: you're not stuck.

Texas has real enforcement tools for unpaid child support, including income withholding directly from a paycheck, contempt of court (which can include fines or jail time), suspension of a driver's or professional license, interception of tax refunds, and liens against property.

We also know this from the other side β€” sometimes a parent falls behind because of a genuine hardship, not because they're trying to avoid their responsibility. If that's you, addressing it proactively (rather than waiting) is almost always the better path.

Whichever side of this you're on, you don't have to sort it out alone. πŸ“ž 817.405.9007

Not Married to Your Child's Other Parent? Start Here.

In Texas, a father's child support obligations and ability to play a meaningful role in a child's life generally don't automatically kick in just because his name is on the birth certificate β€” if the parties are not otherwise in agreement this typically will require a court order.

This step matters for both parents. For a mom seeking support, it's often the necessary first move. For a dad wanting a real say in custody, visitation, and decision-making, it's how those rights get secured β€” not assumed.

If you're navigating this as an unmarried parent, let's get the paternity piece handled the right way, from the start. πŸ“ž817.405.9007

Mediation Doesn't Mean Going Without a Lawyer

Here's something people often get wrong: choosing mediation doesn't mean you're on your own.

Many people work with their own family law attorney throughout the mediation process β€” for advice, document review, and making sure any agreement actually protects their rights before it's signed.

Mediation and legal representation aren't either/or. They can work together.

What Counts as "Income" for Child Support?

"Net resources" sounds simple, but it covers more than just a paycheck.

Under Texas law, the resources used to calculate child support can include wages, salary, self-employment income, commissions, bonuses, overtime, rental income, retirement and pension income, unemployment benefits, and even certain gifts β€” minus taxes, union dues, and the cost of the child's health/dental insurance.

This matters most when someone is self-employed, works seasonally, or has income that fluctuates. A guideline calculation is only as accurate as the numbers going into it β€” which is exactly where things tend to get contested.

If your situation involves anything other than a straightforward paycheck, that's worth talking through before numbers get set.

If you've ever tried to estimate what child support will look like in your case, you're not alone.

The state uses a percentage-based formula applied to the paying parent's net monthly resources (income after taxes and a few specific deductions, not gross pay):
πŸ”Ή 1 child β€” 20%
πŸ”Ή 2 children β€” 25%
πŸ”Ή 3 children β€” 30%
πŸ”Ή 4 children β€” 35%
πŸ”Ή 5 children β€” 40%
πŸ”Ή 6+ children β€” not less than the 5-child amount

There's also a lower percentage schedule for parents with very limited income, and the percentages apply up to a resources cap that the state adjusts periodically β€” above that cap, support can still be ordered based on the child's proven needs.

The formula is a starting point, not the whole story. Every family's numbers look a little different once you factor in self-employment income, other kids, health insurance, and more.

If you're trying to figure out what this might mean for your family, we're happy to walk through it with you. πŸ“ž 817.405.9007

Life Changed. Can Your Child Support Order Change Too?

A job loss. A big raise. A new baby. A move.

Life doesn't stay still, and sometimes a child support order that made sense a few years ago doesn't fit anymore.

In Texas, a support order can potentially be modified when there's been a material and substantial change in circumstances β€” or, in some cases, simply because enough time has passed and the guideline amount would now come out meaningfully different.

Here's the part people often get wrong: an existing order stays in effect, and enforceable, until a court actually changes it. Informal agreements between parents ("we just worked it out ourselves") aren't the same as a modified order β€” and that gap can create real risk down the road.

If your circumstances have shifted, let's find out whether a modification makes sense for you. πŸ“ž 817.405.9007
