A DUI arrest does not equal a conviction.

Recently, we represented a local county firefighter in Loudoun County General District Court. His job, license, reputation, and future were all on the line.

After trial, the Court found him NOT GUILTY of DUI. The related speeding charge was also dismissed after issues were identified with the speed calibration evidence.

Every case is different, but this result is a reminder that allegations are not convictions and that a careful review of the evidence matters.

Can a Parent Be Arrested for Disciplining Their Child in Virginia?

The answer may surprise you.

Virginia law recognizes a parental discipline privilege. A parent may use reasonable and moderate physical discipline to correct a child. The law does not make all corporal punishment criminal.

However, many parents find themselves investigated—or even arrested—before a court ever determines whether the discipline was lawful.

Virginia courts look at several factors, including:

• The child’s age and size
• The child’s conduct
• The reason for the discipline
• Whether an object was used
• Whether marks, bruises, or injuries resulted
• Whether the parent acted calmly or in uncontrolled anger
• Whether the punishment created a risk of serious harm

The key legal question is whether the discipline remained within the bounds of moderation and reason.

Virginia appellate courts have repeatedly recognized that parents retain the right to use reasonable corporal punishment. At the same time, that privilege ends when discipline becomes excessive, cruel, or causes significant injury.

Unfortunately, law enforcement officers responding to family situations often must make quick decisions based on limited information. That can result in criminal charges being filed in cases where a parent believes they were lawfully disciplining their child.
