permission?" Attorney Steven L. Duckett, Jr. has some news for you. In this video,
he explains that Virginia is a one-party consent state, meaning a phone call can be
recorded without the other person's consent. It's one of those laws that surprises
a lot of people.

That traffic ticket might seem like an easy problem to solve. Just pay it and move on... right? Attorney Tyler D. Andrehsen explains why "just paying the ticket" is not always as simple as it sounds. Tickets can add points to your license, and if enough of them pile up, you could be looking at a suspension or even a revocation. Sometimes the easy button is not actually the easy button.

Can you talk your way out of a DUI?

Attorney Steven L. Duckett, Jr. has a different suggestion: talk less. A lot less. During a DUI investigation, the officer is already gathering information. The more you talk, the more opportunities there are for your own words to be used against you in court.

Can you be charged with DUI in Virginia if you refuse field sobriety tests?

Attorney Lili R. O’Connell explains that the answer is yes. Field sobriety tests are generally voluntary, but refusing them does not automatically prevent a DUI arrest. An officer may still make an arrest if they believe there is probable cause.

Being charged does not mean you are guilty. The evidence still matters.
