Missing a court date in Virginia? Here’s why it matters.

Attorney Tyler Andrehsen explains that for a traffic infraction, the court may find you guilty in absentia, meaning you can be found guilty even though you were not there. That can lead to fines and points on your license. For a misdemeanor, missing court is much more serious. Depending on the judge and the situation, the court may issue a capias, which is a bench warrant for your arrest.

The takeaway: always show up for court. If you missed your court date, talk to an attorney as soon as possible.

Our defense attorneys chime in on how likely or unlikely jail may be for driving 105 mph in Loudoun, Fauquier, Prince William, and Fairfax County. In Virginia, 105 mph is usually charged as reckless driving, a Class 1 misdemeanor, so the county and facts matter.

Virginia’s Clean Slate law takes effect July 1, 2026, but not every record will be sealed automatically, and not every conviction will qualify.

In this video, attorney Tyler Andrehsen explains that domestic assault convictions do not qualify for sealing under Virginia’s new Clean Slate law. He also discusses that there are other charges listed under Virginia law that may be excluded from sealing.

In Virginia, reckless driving is not just one charge. It can be based on speed, passing a stopped school bus, racing, driving too fast for conditions, improper passing, failing to yield properly, and other driving behaviors.

That matters because reckless driving in Virginia is not just a regular traffic ticket. It is generally a Class 1 misdemeanor, which means it can carry serious consequences beyond a fine.

This past weekend, our BFL crew got dressed up in our best Hollywood Glam for the Prince William County Bar Dinner Dance at the Westfields Marriott.

It was a beautiful night of awards, dancing, and celebrating with the local legal community. It also felt like a little celebration for our own team after such a busy year.

Myth or Fact: You can be found not guilty in criminal court but still be held liable in civil court.

Fact.

Criminal court and civil court are not the same. They use different legal standards, which means a not guilty verdict in criminal court does not always prevent someone from being found liable in a civil case.

Attorney Lili O’Connell explains this using one of the most well-known examples: the O.J. Simpson case.
