AI notetakers cannot offload responsibility for seeking consent from all meeting participants while covertly using recordings to train its AI models.

A judge in the Northern District of California ruled that Otter.ai can be sued as a third-party eavesdropper, not merely a tool acting on a meeting host's behalf, because Otter kept the recordings and used them to train its own AI models. Claims under California's wiretapping law, federal wiretap law, and Illinois' biometric privacy law all survive.

Yana Hart, Clarkson partner and court-appointed co-lead counsel on the case, called it a wake-up call for Big Tech.

The line the court drew matters beyond this one case: an AI tool that simply transcribes a call is different from one that keeps your voice, your words, and your medical or financial conversations to build its own product.

Companies collecting people's personal information to train AI systems don't get to skip asking for consent.

A pair of glasses that look like ordinary Ray-Bans. A recording light that's easy to disable. And, according to a new Guardian article, a growing list of people who found out they'd been filmed only after the footage appeared elsewhere.

The story lands the same place Clarkson Law Firm's pending class action against Meta does: a privacy promise that doesn't match how the product actually works. Ryan Clarkson, Managing Partner, told the Guardian these devices weren't built for user control. In his view, they're built to turn every buyer into what he called a "Trojan horse of surveillance." Asked about where this trajectory leads, he compared the moment to frogs in a boiling pot, watching the temperature rise on privacy rights one convenience at a time.

Our complaint alleges Meta advertised its AI glasses as "designed for privacy, controlled by you" while footage was reviewed by human contractors overseas without adequate disclosure to consumers.

The pattern the Guardian shares this week is exactly why this lawsuit matters. When a device is built to be inconspicuous, the burden of proving you were harmed falls on people who often don't know they were recorded at all. That imbalance is what consumer protection law exists to correct.

Accountability shouldn't wait on Congress

AI companies are giving their systems more access to accounts, transactions, and real-world decisions every month. Regulation is not keeping pace. Federal AI legislation remains stalled, and the responsibility question — who answers when these systems cause harm — is being left to the courts.

Ryan Clarkson, Managing Partner at Clarkson Law Firm, shared his perspective with Axios earlier this month that existing consumer-protection and product-liability law already gives plaintiffs a path forward, regardless of how slowly new AI-specific rules move through Washington. He describes firms like ours as able to act like "private attorneys general," using existing legal tools to hold AI companies accountable.

Last month, Glenn Danas spoke to ABC News Australia about the Monat lawsuit.

ABC News Australia covered the lawsuit Clarkson Law Firm filed against Monat on behalf of former market partners, alleging the MLM built a sales force of 100,000 people in the U.S. without paying wages, overtime, or benefits, or reimbursing basic business expenses. As quoted in ABC News, Danas said most of the people selling for Monat: "failed to break even."

Clarkson Law Firm has filed a proposed class action against Apple over its iCloud Private Relay feature.

The complaint, filed August 6, alleges Apple misrepresented the privacy protections included with iCloud+ subscriptions after researchers found conditions under which the feature fails to hide a user's real IP address.

"Apple built its entire brand on the promise that it would protect its users' privacy when no other company would," said partner Tim Giordano. "For Apple's iCloud users to now learn that for years they were paying Apple a premium for a protection that simply didn't work is an outrageous violation and betrayal of consumer trust and law."

This latest lawsuit comes after Clarkson's $250 million settlement with Apple, preliminarily approved in July, over AI features that were promised but never delivered.
