How can I keep my estate out of probate?

The most effective way to avoid probate is to create a living trust during your lifetime. With a trust, you will be able to have the people and instructions in place for how your assets will be managed. The trust is a legal structure and involves three parties, the settlor, the trustee, and the beneficiary. The person who creates the trust is the settlor, the trustee is the person named by the settlor to manage the assets placed within the trust and the beneficiary is the person or class of people designated to receive the assets placed in the trust.
