On June 18, 2024, President Biden announced a series of immigration actions aimed at helping certain undocumented individuals in the United States. The American Immigration Lawyers Association made this flyer to alert individuals what the basic requirements for the program are, and also to remind individuals that the program has not yet been implemented. It is anticipated to take effect in the late summer of 2024.

Just hours ago a federal court issued a preliminary injunction halting the USCIS fee increase rule that was previously set to occur this Friday, October 2. For those individuals who couldn’t get their applications together in time, this presents an opportunity to file with the existing fee structure before the preliminary injunction is lifted (if that happens at all).

This is a relief to thousands of people with pending applications or who plan to file applications in the near future.

This is a relief to thousands of people with pending applications or who plan to file applications in the near future.

The financially strained U.S. Citizenship and Immigration Services (USCIS) said Tuesday it would cancel the planned furlough of 13,000 workers scheduled for Sunday after sustained bipartisan pressure from Congress.

USCIS workers are still at risk of furloughs. USCIS is in a serious budget deficit and has asked Congress for $1.2 billion in funding. Though the funding was included in the next coronavirus relief bill, stalled discussions over the next stimulus package have delayed the bill's passing, leaving the bill at a standstill. If USCIS does not get the funding it needs this month, more than 70% of its employees will be furloughed at the end of August. This would grind the immigration system to a halt.

If you currently have an application pending with USCIS (green card, family petition, citizenship, temporary employment status, waiver, asylum, extension of stay, EAD, etc.) you can expect your estimated processing time to at least quadruple if USCIS does not receive this funding.

Although there's a long list of exemptions to the green card ban, most employment-based green cards are frozen. The point of most employment-based green cards is to satisfy jobs for which there are no qualified U.S. workers -- that's the Labor Department's standard. So to say the green card ban provides jobs to U.S. workers is false by definition. This hurts businesses and families. I see it in my practice every day.
