Good News for Ukrainian Citizens who were paroled into the United States at a port of entry ( including Mexican border) between February 24, 2022 and April 25, 2022. The Department of Homeland Security announced on Monday, March 15 that your humanitarian parole will be automatically extended for one more year from the day of the expiration of your current status. Immigration services informed us that your don't have to file any documents to extend your status. Your form I-94 will be automatically extended by the government and you can retrieve your new I-94 on their website: https://i94.cbp.dhs.gov/I94/ #/home

The Immigration services also informed us that if you currently have employment authorization based on your previously granted parole, such employment authorization will be also extended for one more year, and a new Form I-797C evidencing extension will be mailed to the address on file with USCIS.

Attention to all Ukrainian citizens who arrived or lived in the U.S. before April 11, 2022. Application for a Temporary Protected Status is now open. The original timeframe eligibility has also changed - all Ukrainians residing in the U.S. as of April 11, 2022 would be eligible for TPS which also includes application for work authorization and travel document. The registration period for eligible individuals to submit TPS applications begins today, April 19, 2022 and will remain in effect through October 19, 2023.

In my previous post I listed all immigrant and non- immigrant options for Ukrainian citizens who are outside of the United States. See my post bellow.

This article lists help options from the U.S. Citizenship and Immigration Services to Ukrainians in the U.S.

USCIS reminds the public that we offer immigration services that may help people affected by extreme situations, including the invasion of Ukraine. The following measures may be available on a case-by-case basis upon request:
1. Changing a nonimmigrant status or extending a nonimmigrant stay for an individual currently in the United States. If you fail to apply for the extension or change before expiration of your authorized period of admission, we may excuse that if the delay was due to extraordinary circumstances beyond your control;
2. Reparole of individuals previously granted parole by USCIS;
3. Expedited processing of advance parole requests;
4. Expedited adjudication of requests for off-campus employment authorization for F-1 students experiencing severe economic hardship;
5. Expedited adjudication of petitions or applications, including employment authorization applications, when appropriate;
6. Consideration of fee waiver requests due to an inability to pay;
7. Flexibility for those who received a Request for Evidence or a Notice of Intent to Deny but were unable to submit evidence or otherwise respond in a timely manner;
8. Flexibility if you were unable to appear for a scheduled interview with USCIS;
9. Expedited replacement of lost or damaged immigration or travel documents issued by USCIS, such as a Permanent Resident Card (Green Card), Employment Authorization Document, or Form I-94, Arrival/Departure Record; and Rescheduling a biometric services appointment.

Note: When you request help, please explain how the impact of the extreme situations or unforeseen circumstances, such as the invasion of Ukraine, created a need for the requested relief.

The Department of Homeland Security (DHS) announced today designation of Ukraine for Temporary Protected Status (TPS) for 18 months. Individuals eligible for TPS under this designation must have continuously resided in the United States since March 1, 2022. Individuals who attempt to travel to the United States after March 1, 2022 will not be eligible for TPS. Ukraine’s 18-month designation will go into effect immediately.

In the next couple of days DHS will provide instructions for applying for TPS and an Employment Authorization Document (EAD). TPS applicants must meet all eligibility requirements and undergo security and background checks.

FY2023 H-1B Registration Fact Sheet for Employers
Registration Process

To file H-1B petitions subject to the FY2023 cap for an employee, you must first electronically register and pay a $10 fee for each electronic registration. The electronic registration includes basic information about the employer and employee. This year, registrations must be submitted between March 1 and March 18, 2022.

When you register, you must pay a non-refundable $10 fee online for each registration using the pay.gov portal. Payment can be made by ACH from a bank account, a credit card, or a debit card. This fee is in addition to the filing fees you will have to pay later with the petition if the employee is selected in the cap lottery.

Employers are prohibited from submitting more than one registration for the same prospective H-1B employee. If an employer or its attorney submits more than one registration for the same H-1B candidate in a fiscal year, all registrations for that candidate will be invalid. USCIS has created a tool to allow employers and their attorneys to check for duplicate registrations.

After the registration period, USCIS will randomly select registrations from the ones it has received and will electronically notify you or your attorney if your employee has been selected. This will happen no later than March 31, 2022. If your employee’s registration is selected, then you will have at least 90 days to file a fully prepared H-1B cap-subject petition for the employee beginning on April 1. If your employee’s registration is not selected, they will be put on a waitlist and more registrations may be randomly selected during the fiscal year.

What Should I Do Now?

Schedule a meeting with our office to discuss prospective H-1B petitions and whether the job and the individual would qualify for an H-1B. You should also discuss the timing to file your H-1B petition with us. To do this, you should:

Starting at noon Eastern Time on February 22, set up an employer account on myUSCIS as an “H-1B registrant."
Call our office with any questions.

Be prepared to discuss your expectations for processing your case and how quickly it needs to be filed if selected. We will also discuss options if your registration is not selected.

Important Registration Dates

• February 22: Employers may begin creating myUSCIS H-1B registration accounts
• March 1: Registration period opens at noon Eastern Time
• March 18: Registration period closes at noon Eastern Time
• By March 31: USCIS conducts the lottery and electronically notifies selected registrants
• April 1: Filing period begins for selected cases ONLY
