Picture this: your employer promises you a bonus if you hit your targets, or a severance package if your position is eliminated. You do your part. Then, when it's time to pay up, they call it "discretionary" and pay you nothing.

That loophole is exactly what New York's Wage Payment Integrity Act (S2236A/A2222A) is designed to close. The bill would expand the legal definition of "wages" to include bonuses, unless an employer clearly says in writing beforehand that the payment is discretionary, and would let workers use the same legal tools that recover unpaid wages to go after withheld severance and benefits too.

Thanks to bill sponsors State Senator Andrew Gounardes and Assemblymember Jo Anne Simon, the bill passed the NYS legislature with strong bipartisan support and now heads to Governor Hochul, who could sign it any day.

Imagine getting fired and only then discovering there's a write-up in your file from two years ago that you never knew existed.

Right now, that's legal in New York. Employers aren't required to show workers what's in their own personnel file, so people often don't find out what's being used against them until it's too late to fix it, sometimes not until they're already in a lawsuit.

The Personnel Records Bill (S3460/A2107) would change that. It passed the NY Senate and Assembly this year and would require employers to give workers a copy of their complete personnel file, free of charge upon request.

22 other states already have laws like this. New York doesn't, yet. Governor Hochul's has until the end of the year to sign it.

Imagine losing your job with no warning, then learning the company's CEO had spent years stealing hundreds of millions of dollars from investors, and has now been convicted for it.

Christine Hunsicker, founder and former CEO of fashion-tech company CaaStle, pleaded guilty to securities fraud and was just sentenced to five years in federal prison, ordered to pay more than $283 million in restitution and forfeiture. Meanwhile, hundreds of former CaaStle employees were laid off this year without the notice the law requires before a mass layoff, and they still haven't been paid what they're owed.

New York's Remedial Construction of the Labor Law Act (S9330/A10365) passed both chambers with overwhelming bipartisan support: 53-7 in the Senate, 129-12 in the Assembly. All it needs now is Governor Hochul's signature.

For decades, New York courts interpreted the Labor Law broadly to protect workers. That principle has been at risk of erosion since the U.S. Supreme Court's 2018 decision in Encino Motorcars v. Navarro, which turned its back on more than 70 years of applying that same approach to federal wage law.

Courts have often held that New York law tracks federal law. But when federal courts and agencies turn their back on worker protections, whether through a single Supreme Court decision or the Trump administration's broader rollback of wage and hour enforcement, New York shouldn't be dragged along by default. New York has its own Labor Law, passed by its own Legislature, and it should stand on New York's own terms, not get reshaped by the federal courts or the White House.

It's not a new legal approach. New York took the same step for its Human Rights Law (Exec. Law § 300) back in 2019, and courts have applied it as intended ever since.

The bill drew support from National Employment Lawyers Association/New York (National Employment Lawyers Association New York), the National Employment Law Project. It is sponsored by work justice champions Senator Jessica Ramos and Assemblymember Harry Bronson.

The bill will soon head to Governor Hochul. With Labor Day approaching, we're hopeful she'll have the chance to sign it around that date.

New York workers just got closer to a major new protection. The Anti-Waiver of Employment Rights Act passed the Legislature with overwhelming bipartisan support (135-2 in the Assembly!) and is now waiting for Governor Hochul to sign it.

What does it actually do? It stops employers from sneaking class action waivers, shortened filing deadlines, and forced arbitration (when not required by federal law) into job applications, onboarding paperwork, and other fine print workers sign are required to get or stay hired, long before any dispute even exists.
