The Importance of Having Enough UM/SUM Auto Insurance
Once upon a time, I assumed that everyone with a car carried 100/300 in insurance coverage. I eventually learned that most people carry the minimum: 25/50. If you cause an accident and someone is seriously injured, that limits their recovery to $25,000 regardless of the injury. And if you’re the injured party making a claim against someone with the minimum insurance, you’re in the same situation- unless you have higher limits of UM/SUM insurance.
UM/SUM coverage is designed to allow you to make a claim with your own auto insurance carrier if you’re in an accident with an uninsured driver, or underinsured, or in a hit and run, or if you’ve settled your case for the full policy amount but it’s inadequate to compensate you for your injuries. There are a few very important things to remember if you’re in that situation.
MANY PERSONAL INJURY LAWYERS DON’T UNDERSTAND UM INSURANCE.
Personal injury lawyers love to tell their clients “we settled for the full policy!”- and sometimes that’s a real victory. But other times it’s just the beginning. As long as you have higher limits of insurance than the other driver, if they caused the accident, and their carrier pays you the full policy, you can go after your own policy, if you notify your own carrier promptly and your injuries warrant it.
If you’ve been injured in a car accident that was not your fault, and are about to settle for the full policy amount but it’s too low to compensate you for injuries, and you have higher limits of insurance than the other driver, and your lawyer tells you “there’s nothing more we can do, we got the full policy”- CALL ME. 516-724-0314.
