You have filed bankruptcy. You received a discharge from the Bankruptcy Court. What happens now? To start with, you’re no longer down and out. So to speak, you become a credit virgin. Various Terms Defined

Physical Custody: This refers to a situation where an adult lives with a child. The adult is responsible for the child and takes care of the child’s day to day needs.

Legal Custody: Legal custody deals with an adult being responsible for making important decisions with regard to education, religion, medical matters and other matters of importance for a child.
Custody: The word custody actually means to be in charge of someone. There are two types of custody, legal custody and physical custody. Physical custody indicates the child lives with the parent. Legal custody can only be given by a Judge who issues a court order.

Guardianship: There are two different types of guardianship. There is guardianship of property and guardianship of a person. The guardianship of a person deals with an adult who takes care of someone who is not able to take care of themselves. An adult can be the guardian of a child. The guardian of a child is responsible for taking care of the child in making decisions on a day to day basis for the child. In New York there are no significant differences between custody and guardianship.

Becoming a Guardian: Petitions can be brought either in the Surrogate’s Court or in the Family Court. The petition must allege why the individual who seeks guardianship is appropriate. It also must show the benefits to the person they seek to be guardian of.

Grandparents Seeking Visitation

In the event the children’s parents interfere with or prevent the grandparents from communicating and/or visiting with their grandchildren, the courts in New York provide legal remedies to deal with these situations. The grandparents must bring an application to the Family Court, in the State of New York, pleading it is in the best interest of the children to have access and visitation with their grandparents. In these applications the attorneys must plead the grandparents had previously had warm and loving relationships with the children and enriched the children’s lives. The legal burden is on the grandparents to prove extraordinary circumstances and that the visitation is in the best interest of the children. Upon appearing in court, the courts will look into whether the grandparents can rebut the presumption that the parents’ decision to prevent the grandparents from having visitation or access with the children was appropriate and in the children’s the best interest.

New York Division of Retirement Plans

Retirement plans of all types and nature including but not limited to 401 k plans, 403 b plans, IRA’s, pension plans, profit sharing plans and all other retirement compensation plans are equitable distributed in a divorce. All benefits accrued in the aforementioned plans during the term of the marriage are considered marital property.

Majauskas Formula

There was a case called Majauskas v. Majauskas in New York State. This case set the standard for the division for all types of retirement plans. The Majauskas formula regarding the division of Retirement Plans as follows:

A fraction is created. The numerator consists of the number of months in the marriage.
The denominator is the number of months the asset accrued due to the employment of the husband or wife.
An accrued benefit would consist of the amount received by the spouse in his or her retirement plan.
The accrued benefit is multiplied by the equation of the numerator and the denominator.
Thereafter, that figure is multiplied by the percentage received by the non-titled spouse. In most long-term marriages, this amount is 50%.

Example: Lets say a husband’s retirement benefit is a $1,000 per month. The number of months the pension accrued during the course of the marriage is 100 and if the number of months of total pension credit is 200 the amount paid by the husband to wife is determined by dividing 200 by 100 which equals 50% and then that figure is multiplied by the 50% equitable distribution (pursuant in a long term marriage) resulting in a percentage to be received by the wife of 25% of the pension benefit. In the case of this example, that would be $250 a month upon the retirement of the husband. To effectuate the division of most retirement plans a actuarial analysis if very often required. Thereafter, a specialized court order called, a "Qualified Domestic Relations Order" (QDRO) needs to be submitted to the Judge on the case and thereafter signed by the Judge and served on the Administrator of the Pension or Retired Benefit Plan.

Divorce is one of the most emotional experiences a person will ever face. The decision to end a marriage is not an easy one and it is often accompanied with anger, fear, and resentment. The negative emotions associated with divorce are responsible for more than hurt feelings; they affect the final outcome of settlement negotiations. Most important, if children are involved, they will suffer. It is in your best interest to approach divorce from an amicable perspective. This will allow you to put on your business hat, which is critical for reaching a successful settlement. It will also allow you to put on your effective parent hat, which is critical for helping your children through this difficult process. An experienced family law attorney can help you see your situation clearly and objectively.

Bill Ferguson, a nationally recognized divorce and relationship expert on divorce and healing, recommends several steps that will help you remain amicable with your spouse during divorce proceedings.

Bill describes the cycle of conflict people engage in when ending a marriage. One person says something nasty, the other responds. It takes two people to create and maintain a cycle of conflict. It only takes one person to end it. To end the cycle of conflict, you need to stop fueling it.

The following tips will help you end your part in the negative cycle and help you achieve an amicable divorce:

1. Acceptance – If you don’t accept someone as they are, you will end up frustrated and more likely to continue to contribute to the conflict. Face it, your spouse isn’t going to change any more than a leopard will change its spots.

2. Feeling Hurt – Feelings of hurt drive more behavior than most people will admit. Often, anger is simply an unwillingness to feel hurt. If you allow yourself to feel hurt, it will run its course more quickly and allow you to move beyond it. Remember, crying is simply a means of relieving stress.

3. What’s Your Part? – Take the time to think about yourself, not the other person. Ignore what they did or said and think about what you did and said. Were you more critical than you should have been? Did you hurt their feelings? Notice how the other person has put up his or her walls of protection and given it back to you. See how your actions have fueled the conflict.

4. Let Go & Forgive – In many ways not letting go is a form of denial. We hang on to avoid feeling pain, but the pain won’t go away until we actually experience it. Become willing to feel the hurt and watch the need to hang on disappear and your ability to forgive grow. Forgiveness is for you, not the other person.

5. Listen – An argument is an example of two people talking but no one is listening. Once someone stops to listen, the argument ends. Take the time to listen, then calmly express your opinion and again take the time to listen. You will find solutions.

There are many more tips and techniques you can use to diffuse the tension between you and your spouse. Even if you decide to pursue a divorce, you can make it more amicable. Remember, when you fight to have your side prevail, you force the other person to fight against you. If you are committed to finding solutions that work for both of you, the resistance against you dissolves. It’s hard to fight someone who’s on your side. Family law attorneys, too, are interested in reaching an amicable resolution with the least animosity possible, and can be your best allies in achieving the most beneficial resolution of your case.
