I hear some version of this almost every week. Sometimes the client says it quietly.

Sometimes they say it with absolute certainty. Sometimes they say it within the first thirty seconds of the consultation.

“Gary, my ex is crazy.”

Now, before anyone gets angry, let me make something clear. Sometimes people really do have mental health issues. Depression is real. Anxiety is real. Bipolar disorder is real. PTSD is real. Substance abuse is real. Serious psychiatric illnesses exist, and they can absolutely affect families and children.

That Maybe So, But Does That Affect Their Ability to Parent?

06/01/2026

One of the most common things I hear from clients is:

"My ex is crazy. Doesn't that mean I'll get custody?"

The answer is usually more complicated than people expect.

In New York custody cases, a diagnosis alone is rarely enough. Courts do not decide custody based on labels, rumors, or amateur diagnoses. The real question is whether a mental health condition affects a parent's ability to safely and effectively care for their children.

In this video, I explain:

• Why mental health records are difficult to obtain
• How judges review confidential psychiatric records
• Why a bad spouse is not automatically a bad parent
• What evidence actually matters in custody litigation
• How Family Court focuses on the best interests of the child

If you're involved in a divorce or custody dispute and mental health issues are being raised, understanding what the court is actually looking for can save you time, money, and unrealistic expectations.

One of the things I have learned after years of handling divorces is that clients rarely arrive with legal questions. They arrive with fear.

Most people see divorce as one giant impossible problem.

My job is usually helping them discover that it is really a series of smaller, manageable problems.

I wrote about that here...

A few years ago, I realized something strange about my profession. People think divorce lawyers solve legal problems. We do, of course…

Thinking about filing for divorce in New York? Most people imagine screaming courtroom battles and dramatic TV moments. In reality, divorce usually begins much differently.

In this video, New York divorce attorney Gary Port explains:
• how divorce cases actually begin in New York
• the difference between a lawyer’s letter and formal filing
• when emergency Orders to Show Cause are used
• why filing for divorce is a legal process, not an emotional explosion
• common mistakes people make at the beginning of divorce

If you are overwhelmed and don’t even know what questions to ask yet, that’s normal. One of the first jobs of a divorce lawyer is helping clients break one giant terrifying problem into smaller manageable ones.

More and more people are uploading screenshots, bank records, custody notes, and even legal strategy into AI tools like ChatGPT without realizing those conversations may create a digital trail.

In this video, New York divorce attorney Gary Port discusses:

whether AI chats may become discoverable,
why ChatGPT is NOT protected by attorney-client privilege,
the growing problem of fake AI evidence and deepfakes in custody cases,
and how digital evidence is changing divorce litigation.

The law is evolving fast, but one thing is clear: technology has a habit of becoming evidence.

If you are involved in a divorce or custody dispute in New York, especially one involving digital evidence, hidden assets, screenshots, or online communications, you need to understand the risks before you upload sensitive information into AI systems.

When families hear the word “guardianship,” they often assume it’s a long, complicated court process.

In reality, an Article 81 guardianship case in New York is structured, focused, and often resolved more quickly than people expect.

In this video, I walk through what actually happens:

How the case starts
What a court evaluator does
How the judge reviews the situation
And how the court protects the rights of the alleged incapacitated person throughout the process

Most cases are not about taking control—they’re about creating a structure that works when things start breaking down.

Understanding the process can make a difficult situation a little clearer.

Everyone thinks crypto is the perfect hiding place in a divorce.

It’s not.

The same technology that lets you move money instantly also creates a permanent record. With the right tools, wallets get traced, transfers get mapped, and the story comes together fast.

And here’s where it gets painful: if a judge believes you tried to hide assets, they can shift the cost of discovery onto you. That means paying for forensic experts, legal fees, and possibly more.

This isn’t theory. This is happening in real cases.

If you’re dealing with digital assets in a divorce, you need to understand both the technology and how courts are reacting to it.

Most people think trial is where a divorce case finally gets decided.
They’re wrong.

Trial day is actually the court’s last, best opportunity to force a settlement before things become expensive, unpredictable, and out of your control.

In this video, I walk you through what really happens on trial day:
– Why judges delay or interrupt proceedings
– The subtle (and not-so-subtle) ways courts push settlement
– Why so many cases settle at the courthouse steps
– The difference between custody trials and economic trials
– What happens after trial, including post-trial submissions

If you’re going through a divorce in New York, this is the part of the process most people misunderstand—and where the stakes are highest.

Most people walk into divorce thinking their private messages are… well, private.

They’re not.

In New York divorce and custody cases, texts, emails, social media, and even metadata can become evidence. And once it’s out there, you don’t get to put it back in the box.

In this video, I break down how digital privacy actually works in divorce, what courts can see, and the mistakes that can quietly destroy your case.
