The Texas Department of Transportation (TxDOT) has selected Ferrovial, a large infrastructure company, to design, build, and maintain the SH 99 Grand Parkway Segment B-1 project southeast of Houston, Texas. This project is a 15-mile, four-lane, controlled access toll road from I-45 South (the Gulf Freeway) in League City toward SH 35 in Alvin and on to SH 288 (the South Freeway) near Rosharon through Galveston and Brazoria counties.
TxDOT will take private property from landowners along the project’s route for this toll road. To do this, TxDOT will soon exercise its eminent domain authority to condemn the right-of-way it needs for Segment B-1. Often, TxDOT will offer landowners too little compensation for this forced sale. The process often favors TxDOT because it does not always recognize all of the various impacts on landowners. State law requires fair compensation for those property rights, but TxDOT and its contractors are focused on completing the project, getting right-of-way it needs, and paying the landowner as little as possible. Brady & Hamilton looks to balance this process through careful and competent representation of landowners in projects like Segment B-1.
