Brady & Hamilton is actively representing clients in connection with Kinder Morgan’s efforts to take private property for its Creekside Lateral Pipeline in Bastrop County. This 11-mile, 42-inch natural gas pipeline is designed to serve industrial and data center demands in Central Texas.

Kinder Morgan is expected to spend $85 million to construct this project, but it doesn’t intend to spend that budget on paying landowners. Instead, Kinder Morgan will try to complete the pipeline as quickly and cheaply as possible, with very favorable easement terms for the pipeline.

The Texas Department of Transportation (TxDOT) has selected Ferrovial, a large infrastructure company, to design, build, and maintain the SH 99 Grand Parkway Segment B-1 project southeast of Houston, Texas. This project is a 15-mile, four-lane, controlled access toll road from I-45 South (the Gulf Freeway) in League City toward SH 35 in Alvin and on to SH 288 (the South Freeway) near Rosharon through Galveston and Brazoria counties.

TxDOT will take private property from landowners along the project’s route for this toll road. To do this, TxDOT will soon exercise its eminent domain authority to condemn the right-of-way it needs for Segment B-1. Often, TxDOT will offer landowners too little compensation for this forced sale. The process often favors TxDOT because it does not always recognize all of the various impacts on landowners. State law requires fair compensation for those property rights, but TxDOT and its contractors are focused on completing the project, getting right-of-way it needs, and paying the landowner as little as possible. Brady & Hamilton looks to balance this process through careful and competent representation of landowners in projects like Segment B-1.

Jarrell Express Pipeline:

T2 Transmission, LLC has been granted a permit by the Texas Railroad Commission to construct a new 7.13 mile pipeline in Williamson County. This new natural gas pipeline will parallel Interstate 35 south of Jarrell, and then cut northwest along the C. Bud Stockton Loop past Jarrell High School, then continuing on Highway 344.

T2 will take pipeline easements over private property for this project. T2 is only interested in completing the project as quickly as possible, with pipeline-friendly terms, paying landowners as little as possible. Even though Texas law requires that T2 pay landowners fair compensation for these takings, that rarely happens without expert representation.

Williamson County’s East Wilco Highway Corridor E project consists of four, north-south segments starting at I-35 north of Jarrell and ending at U.S. 79. The County is beginning the process to exercise its eminent domain authority to force landowners to sell property the County needs for its right-of-way. Brady & Hamilton represents landowners affected by Williamson County’s public infrastructure projects.

The County will take property from landowners along the route, often offering too little compensation. Unless negotiated or litigated competently, the forced sale will often favor the County because it does not always acknowledge all the impacts to landowners. Although Texas law requires the County to pay fair compensation to property owners, the County and its contractors are focused on completing the project, getting the right-of-way it needs, and paying landowners as little as possible.

Targa has recently announced an extension of its Bull Run pipeline in Winkler and Ward Counties. This 42-inch pipeline will run approximately 43 miles across the Delaware Basin.

To complete this project, Targa will take pipeline easements over private property. Even though Texas law requires that Targa pay landowners fair compensation for these takings, Targa is only interested in completing the project as quickly as possible, with pipeline-friendly terms, and paying landowners as little as possible.

Williamson County will soon begin taking private property from landowners along County Road 201 from County Road 200 to Umbrella Sky. The CR 201 project will be a new 2-lane road with 2-foot shoulders and turn lanes. The new road will be built on property adjacent to the existing roadway, and once that is complete, traffic will be moved to the new lanes, and the old County Road 201 pavement will be removed. Brady & Hamilton represents landowners affected by public infrastructure projects like the County’s.

The County will take property from landowners along the route, often offering too little compensation. Without competent representation, landowners run the risk of a forced sale favoring the County, because the process does not always recognize all the impacts on landowners. State law requires fair compensation for those property rights, but the County and its contractors are focused on completing the project, getting right-of-way it needs, and paying the landowner as little as possible.
