After pausing the project for several years, the Texas Department of Transportation (TxDOT) is moving forward with its expansion of RM 620 near Anderson Mill Road, in Travis and Williamson Counties. The project will stretch only 1.2 miles but will affect dozens of property owners; some commercial buildings will be bisected by the new right-of-way takings. Other businesses may be displaced due to negative impacts from the project on their remaining property.

Although TxDOT is obligated under Texas law to pay fair compensation when exercising its eminent domain authority, TxDOT is primarily focused on completing the project on schedule and at the lowest possible cost. Brady & Hamilton is actively representing numerous landowners affected by a new pipeline, being built by MPH Bastrop Lateral, LLC. The new pipeline will be approximately 30 miles long and 30 or 36 inches in diameter. The pipeline will interconnect with an existing pipeline in Lee County and transport natural gas to Bastrop County.

The pipeline company will take easements from landowners along the route. Unless negotiated carefully and competently, the easement terms will favor the pipeline company. And although Texas law requires fair compensation for those property rights, the pipeline company is focused on completing the project, getting easement terms favorable to it, and paying the landowner as little as possible.

The Texas Department of Transportation (TxDOT) is moving forward with upgrading US 77 near Woodsboro and developing a new US 77 highway to bypass Refugio to the east. To develop this project, TxDOT will have to take landowners’ property through eminent domain.

The Texas Department of Transportation (TxDOT) is in the process of taking landowners’ property for this project, and while state law mandates fair compensation for property taken, TxDOT is only interested in completing the project as quickly and inexpensively as possible.
