Don’t Fly, Even Within the United States
If there is something wrong with your immigration status, don’t fly. There are credible reports that TSA (the screen everyone at the airport people) are giving lists to ICE (the detaining people with defects in status people).
If you have a Final Order of Removal, Expired Visa, Canceled TPS, Non Valid Student Visa, Absentia Order, You are an EWI (entered without inspection), you are likely to be detained.
If you are detained, trying to get our is really expensive – lawyer fees and bond – and may well end your time in the United States after a lengthy stay in custody.

Mullins, the head of DHS, on Haitians applying for “a permanent status”

I read this as telling all of the who will be losing TPS to apply for a permanent status – A green card is a permanent status and so is Asylum.

Mullins (the current head of DHS) is quoted by Reuters when speaking of Haitians “either try to fill out the paperwork and be here underneath a permanent status or we will help you get back to your country” on CNN’s State of the Union. Apparently CNN opted to put these comments behind a paywall and instead featured Mullin’s “go home message.”
The following is the Reuter’s link to the quote. I take the quote (the quote, not the Reuters comment) as endorsing allowing Haitians time to file Asylum applications (a permanent status). -

Markwayne Mullins' comments came after the Supreme Court allowed the Trump administration to strip hundreds of thousands of Haitians and Syrians of their protected status.

>>I am very please that a court has spoken in rebuke, I expect that there will be a prompt Appeal by the overreaching Trump administration and a Emergency Motion to Stay (so the order’s effect will not continue pending appeal).

Worried about getting your Green Card? or Having to leave the country to get it?

Last week’s (21-22 May 2026) Immigration Memo (“the memo”) has caused a lot of worry.

Here is what I think the memo says:
If you came here on a Non-Immigrant Visa, you will have to provide a reason why you want to get a Green Card without going back to your home country.
There are many non-immigrant visas (“NIV”) holders here and for many years, there has been little restriction to becoming a Permanent Resident (Green Card Holder) if you entered on a NIV, no matter how long ago.
NIVs include: B1, B2, J, F, P, A. and to some extent K. There are also “dual intent” employment visas. For the purposes of the memo, we think there is NO IMPACT on K Visas, as the intent was always to come and stay.

What it means:
Policy Memos, even from DHS, are not law!
There are lots of people who have been here longer than their visa validity and some with orders of Deportation. The seriousness of the dilemma ranges from a F Student who has been here for several years and marries and wants to get a Green Card before going home to someone who came in the 1990s and wants to stay to someone with a final order of Deportation after a failed Immigration Court case.
These are cases with potential problems. Please! Take action before anything happens to you. You should talk to an experienced lawyer.
