PSA: Please check your car insurance policies to make sure you have the best coverage that you can afford. Often times, people come to the office after an accident and tell us that they should be all set because they have "full coverage." This, unfortunately, doesn't really mean they are adequately protected for the injuries and property damage they have suffered.

If you aren't sure about your coverages, consult with an insurance broker. It won't cost you anything. Don't settle for the cheapest coverage online before considering what you are sacrificing should a motor vehicle accident occur.

A classic example of this is the dreaded "PIP Deductible." PIP Coverage or Personal Injury Protection Coverage pays for the first $2,000.00 in accident related medical expenses, co-pays, deductibles, and perhaps most importantly uncompensated wages. When you take a PIP deductible, this means that you are declining this coverage for yourself ultimately saving very little money on the premium and costing yourself needed funds caused by an unanticipated loss.

We are seeing an alarming trend with clients taking PIP deductibles on their auto insurance. We strongly advise against doing this and here are just a few reasons why.

1. Personal Injury Protection benefits serve multiple purposes. They are a NO FAULT benefit that pays the first $2,000.00 of your medical expenses associated with a loss. After that, the bills are coordinated with your private health insurance carrier with the PIP benefits covering out of pocket expenses, deductibles, and co-pays. This coverage is available up to the maximum $8,000.00 benefit.

2. PIP benefits can also be used to pay your wages. If you do not have sick/vacation time available, PIP will pay 75% of your gross weekly wages up until the maximum available benefit of $8,000.00 is exhausted.

These benefits are extremely helpful to insure that you don't have out of pocket medical expenses and/or wage loss associated with collision. Again, PIP is available regardless of fault meaning whether you caused the accident or not.

You should also consider the following:

1. In all likelihood, you have a private health insurance deductible too! Your bills associated with a motor vehicle collision then become your personal responsibility because your auto insurance deductible and private health insurance deductible will not cover the charges. The money that you saved on your premium is lost with your first medical bill associated with the collision.

2. By taking a PIP deductible, no compensation for wages is available. Unless you have a great deal of sick and vacation time available, your lost wages aren't covered and the financial losses will grow.

Saving on car insurance seems like a good idea until you need it. As loving and friendly as the insurers seem in the commercials, they are not. They will do everything possible to help you save (reduce their exposure by limiting coverage) and have no problem telling you that you don't have coverage for that when you are in desperate need. Please don't fall into the trap.

PSA: One of our Attorneys shared a story we at the Zaim Law Firm felt was very important to share. An elderly family member received a letter that said it was from the Publisher's Clearing House. The letter said that this individual won a million dollars and that she should contact them by telephone confidentially to claim her winnings. It further states that all that was necessary was her bank account routing information so the funds could be wired directly. It stressed that the individual should tell no one so as to avoid any delays in the transaction.

This is a scam preying on the elderly and sick. Please check on your family and friends and insure they will not be victims. Encourage them to talk to you or someone they trust before everything they worked so hard for is taken from them.

TIP: Insurance companies have started using a new strategy. Within the first week of being involved in a motor vehicle collision, they have a representative call you or come to your home with an offer of settlement. They will offer you $1,000.00 for your pain/aggravation and will cover any uncovered medical bills for 30 days.

Here are just a few reasons why you should NEVER accept this offer.

First, you will often not yet understand the full scope of injuries and what will be required for treatment to get you better in just one week. You must seek appropriate medical care as recommended by your treating physicians and therapists.

Second, medical bills are generally paid by a combination of your car insurance and private health insurance. You have an individual contract with your private health carrier that may require you to reimburse them all expenses it paid on your behalf associated with the loss. If you accept $1,000.00 and your insurance company is looking for reimbursement of $4,000.00, you are at a large loss.

Third, you must take a step back and breathe. Understand the full scope of the impact on your life and the lives of your loved ones. For example, if you can't drive, cook, or help with homework, these are all things that have to be considered by the insurance company.

In short, there is no rush. You have three years from the date of the accident to present your claim. To make it easy, come to the Zaim Law Firm and we will take care of everything else so you can take care of you.

Daily, we are amazed by the technology available in motor vehicles from backup cameras to sensors telling us to stay in our travel lane. Remember, there is no substitute for your own eyes and experience. Absolute reliance on technology decreases our awareness of all situations that develop on the road.

It is our goal to help keep people safe by giving safe driving and insurance tips. Unfortunately, not everyone obeys the rules of the road or utilizes safe driving practices. When they fail, things happen on the roads that we cannot anticipate resulting in crashes and injuries.
