Prenups have gotten super common, especially in Northern Virginia (As a high wealth area). If you and your spouse entered into one, it's important to let your estate planner know one is in place.

In Virginia, these contracts are valid and binding and can require that certain things are offered to a spouse in a will or a trust. The problem with the battle of documents here is that a valid prenup is enforceable and does one of two things with estate documents. For ones done before marriage, you'll have to update them. For ones done after marriage, you'll have to consider the prenup.

This week in September is always such a somber time. As an older Millennial, one of my first flashbulb memories was the attacks on September 11th, 2001. It galvanized our country around a common set of ideals and beliefs—community, resilience, and strength.

Over time, we have lost sight of that, but I'm grateful to have grown up in (and to be raising my own family in) an area that still honors those classic values of serving others through both hardship and bounty.

Take a moment today to reflect on the significance of the day, hug your family a little closer, and do something good for your neighbor.

Do right by each other. It is what we're meant to do and what brings out the best in all of us individually and as a community.

You can't spell succession without success... Terrible pun, work with me.

Last week we looked at why your company needs an operating agreement even if it's a single person shop. This week we're talking about succession planning - the thing we do when we think about legacy. Who do I want running things? Who would run things if I don't appoint anyone? What kind of bindings are on them if I don't think ahead?

In all things business, know what's knowable, keep your flexibility for the unknowable unknown. This blog helps give you an idea on what's unknowable and what's knowable, so know what's here. Your single member LLC is an anchor for growth, emergencies, and operations (Not just in Ashburn).

I know what you're saying - it's just me, shut up, nerd.

Well, the truth is that your single member LLC likely doesn't have an operating agreement that functions. If you grow and take on a partner - how do you resolve disputes? Virginia law says votes based on ownership share and dissolves you if you hit gridlock that harms the business. If you have an emergency the ship still needs a captain. If you pass your business is heading to probate and frozen during that whole time.

While an operating agreement for an individual run LLC can seem tedious, if you don't want to leave a nightmare for your heirs, you need one. If you want to avoid probate, filings, and losses, you need one. If you hope to grow, you need one.

As school starts up again shortly, I want to put out a special thank you to everyone following this practice, for the clients and the prospective clients, and the attendees to my events throughout the summer. It's been an absolute blessing to see this grow and to have the opportunity to not only provide services to people but to know that I'm providing peace of mind to people with very real concerns during tough times in their lives.

This practice started with one simple goal - leave everyone better than when they came to me. I'm proud to say that I continue to honor that by being open and generous with educational content and support and letting people know what is and isn't a good fit for them.

I've had the opportunity to untangle complex estates, speak with some amazing professionals to help support clients, and gotten to know some incredible families.

So, as the summer draws to a close, thank you to everyone and I look forward to continuing to serve this community.

I believe in an abundance mindset.

I'm a firm believer that if someone else succeeds that doesn't mean I lose. I want my clients and my prospective clients to be better off than when I found them. Whether that's by providing services, education, or some degree of comfort with their situation, the focus is you, not me.

This means that sometimes I'll be performing work for you. Other times I'll be making referrals to help sort you out. And even sometimes, I'll be letting you know that you've done all the right things and I'm unnecessary.

I share this as a way of thanking each and every person who reaches out to me. I also share this as a a reflection of late - I see the scarcity mindset all too often. The idea that every opportunity has to be captured or that someone feels insufficient with what they've pulled together.

I'm a client-centered attorney with a commitment to doing right by clients. The goal is to meet you where you are, help you nurture what you've done, and get you where you need to be, not to pound in signatures and push out paper.

Anyway, that's what was on my heart today to share. As an estates and business attorney, you're the center of my practice. When I understand you and your priorities I can help you deliver on them. Whether or not I'm the provider is irrelevant. Service first. I'm a simple man like that. If that's your type of lawyer, I'm happy to talk.

It's been a while - so what's new?

The new website is up and running and we'll be adding a new section based on a new bar license that I've added!

As of July 22nd I swore into the Maryland bar - registration is pending but all the requirements have been submitted.

I've made a connection with a virtual and in-person notary to help facilitate client document ex*****on with maximum comfort and flexibility.

I have two events coming up - Pints with Planners on the July 31st and Pints with Planners on August 7.

I'm speaking on artificial intelligence and governance/risks this Friday to a wonderful organization in Wi******er where I hope to help business owners cover down on emerging areas of liability and business.

This coming Tuesday I'm hosting a panel discussion that if you're a business owner, you'll want to see.

With August on the horizon and the kids coming back to school in a few short weeks, I look forward to helping families and business owners solve their issues, reduce their worries, and improve their lives.
