On March 29, 2026, a federal district court in Texas vacated FinCEN’s Residential Real Estate Reporting Rule, effectively suspending the mandatory reporting requirements for non-financed, entity-owned residential transfers that took effect on March 1, 2026. The ruling found that the rule exceeded FinCEN’s authority, rendering it unenforceable nationwide.

As you may be aware, the new FinCEN Residential Real Estate Reporting goes into effect March 1, 2026. The new rule imposes new reporting requirements for any non-financed/cash purchases of residential real estate property by legal entities or trusts (subject to exceptions and exemptions).
