This is from a recent Referee decision on eligibility for UI benefits. ......each of which must be met in order for a worker to be eligible to receive benefits and each of which must be ruled upon individually
1. The worker must be mentally able to work
2. The worker must be physically able to work
The worker must be available for suitable work and
The worker must make a reasonable search for work as might be expected of a prudent person under like circumstances.
The issue here is whether the claimant is able and available to look for and accept suitable work. The claimant is unavailable due to Covid-19 pandemic shut down of schools the claimant's school age children attend. The claimant is the primary caregiver for the four children. The children are unable to go to school, and there are no daycares available due to the COVID-19 pandemic. Therefore, the claimant is ineligible for Unemployment Insurance Benefits."
