In our law firm's criminal law practice, we regularly conduct a thorough defense investigation following an arrest and the posting of bail. Before the first court date, we present the defense evidence (witness statements, physical evidence, character letters, the accuser's background, etc.) in advance of a prosecutor's charging decision. The police reports, reviewed by the prosecutor, may not present a complete narrative of what happened and our written position seeks to provide a more thorough picture of the events leading to the arrest. A recent arrest, which was "rejected for prosecution," garnered publicity. No charges are expected to be filed at the arraignment.
