If you're using AI tools to generate music for your videos, written content for your website, or images for your marketing, you need to be paying attention to this.

In August 2026, a major music publisher filed billion-dollar copyright lawsuits against two AI companies. The suit alleged that their AI systems were trained on copyrighted works without permission. Fair use arguments will be central to the defense. But the legal question underneath is when an AI is trained on copyrighted work, what does that mean for the content it produces?

That question isn't just for the big tech. Small businesses that use AI tools to create marketing content are operating in the wild West. Are licensing agreements in place? What exposure do you have? It's worth understanding before the law catches up.

An IP attorney who follows this space can help you assess your liability. It's better to do this now, than when too late.

Are you using AI-generated music, text, or images in your marketing? Has copyright come up? Drop a comment.👇

Starbucks filed ten times more trademark applications in the first four months of 2026 than it did in the same window the year before.

Large brands are watching the same legal landscape everyone else is: AI impersonation, dupe culture, global counterfeiting, and rapidly shifting IP law. Their response is to move early and move broadly. Small businesses don't have the same budgets. The strategy remains the same. Protection is significantly more effective, and significantly less expensive, before a conflict starts than after.

If you haven't revisited your trademark coverage recently, what's happening right now is a reasonable prompt to do so. An IP attorney can help you assess where the gaps are.

What would have to happen before you'd take another look at your brand's trademark protection?
