Lawyers, Lawsuits and the Legislature are not to Blame for Inadequate Nursing Home Care

It is time corporations to stop blaming their troubles on lawyers, lawsuits, or the state legislature. We certainly don’t need arbitrary damages caps for someone else’s pain or suffering; For instance, in the State of California pain and suffering is capped at $ 250,000.00. We have juries to make these decisions based on the merits of each case. Many many times seriously injured elders and dependent adults have incurred serious injuries only to have their compensation reduced because of unconstitutional damage caps. The large corporations, which own 90% of the Skilled Nursing Facilities in the United States, should focus their efforts on providing quality patient care, thus avoiding lawsuits completely. The focus should be on safety and quality care instead of making it harder for innocent victims to seek compensation for injuries sustained because of poor care and neglect.
