Your listing photos could be putting you at legal risk. They might look completely normal. That's exactly the problem.
A growing number of real estate photographers now run every shoot through AI batch-editing platforms that apply one "editorial" style across an entire gallery in minutes. Skies get replaced. Windows get fixed. Rooms get virtually staged. All by a model that generates new pixels instead of correcting real ones.
Most agents never even know it happened. The photographer isn't trying to misrepresent anything, the software just does it by default, on every photo, automatically.
As of January 1, 2026, California's AB 723 makes that a legal problem, not just an aesthetic one. Digitally altered listing photos now have to be disclosed, with the original available on request.
A 2026 study found 10.8% of nearly 40,000 listing photos across Zillow, Redfin, Realtor.com, and Homes.com showed signs of AI alteration. Over 90% had zero disclosure.
If you're an agent, ask your photographer what tool they use and whether they know the difference between a correction and a generated image. If you're a buyer, know that "looks real" and "is real" aren't the same thing anymore.
