San Francisco Partner Mark R. Wilson recently prevailed on an anti-SLAPP motion after uncovering opposing counsel’s reliance on AI-generated legal authority in court filings. In the underlying case, Plaintiff filed suit against our client, who served as counsel for an insurance company, alleging violations of the Unruh Civil Rights Act following a coverage dispute. Mr. Wilson filed an anti-SLAPP motion arguing the allegations arose from protected petitioning activity, while also identifying multiple citations in Plaintiff’s opposition referencing nonexistent cases. The court granted the anti-SLAPP motion in its entirety, finding Plaintiff failed to produce evidence of discriminatory intent, and formally admonished opposing counsel for violating Rule 3.3(a)(1) of the California Rules of Professional Conduct by citing fabricated legal authority to the tribunal.

Orange County Co-Managing Partner Karen Liao and Los Angeles Associates Lina Hung and Niko Zhou secured a complete dismissal with prejudice for their retail client, defeating claims of negligence and premises liability.

The lawsuit arose from a July 2023 incident where the plaintiff climbed a spiked fence surrounding the client’s warehouse and sustained injuries. After Lina Hung prepared motions for summary judgment and sanctions against the plaintiff for filing a meritless suit, Niko Zhou successfully persuaded the plaintiff and their counsel to voluntarily withdraw the complaint on all actions, delivering a swift defense victory.

Founding Partner Anthony J. Ellrod and Orange County Associate Esteban Ortiz obtained summary judgment for our boxing club client in a personal injury lawsuit. The plaintiff, injured while sparring, claimed the gym was negligent in training, matching partners, and maintaining safety protocols.

Because the plaintiff's parents had signed a release of liability and express assumption of risk agreement upon joining, our team moved for summary judgment.

The Court granted the motion, finding the claims barred by both the signed release and the primary assumption of risk doctrine, as sparring injuries are inherent to the sport of boxing.

Los Angeles Partner Ari Markow and San Francisco Partner Mark Wilson successfully defended our client, a licensed real estate broker, in a breach of contract case!

The plaintiff sought to hold our broker client liable for the alleged fraudulent actions of a real estate agent's entirely separate construction company, claiming a failure to supervise the work. After securing a summary judgment, the Court of Appeal fully affirmed the ruling, rejecting the plaintiff's attempt to hold the broker liable for the actions of an agent’s separate construction company. The court agreed with the defense that a broker's duty to supervise real estate activities does not extend to an agent's independent, outside contractor work.
