“A common question on the Legal Hotline concerns the “Informational Access to Property” paragraph 3L(3) on the RPA: What is Informational Access to Property? This provision simply describes the time period in which the buyer has the right to access the property for investigations. This right is independent of the investigation contingency, meaning, the buyer may have waived their investigation contingency, but still has a right to access the property. That might be the case, for example, where the buyer made a non-contingent offer. Or the buyer may have retained their investigation contingency but no longer has the right of access. That will typically be the case where the buyer has not removed their contingency, but is past the 17 day (default) period allowed in paragraph 3L(3) for informational access. Either way, having a right of access does not create a cancellation right.”- CAR Legal

“With a fixer upper, is it necessary to write into the contract sold “as-is” to ensure that the seller has no duty to make repairs? No. All of the C.A.R. purchase agreements are already “as-is” contracts. Nothing further is required ensure this. However, the RPA does require the installation of smoke alarms, CO detectors and water hater bracing within 7 days after acceptance. Payment for these items is negotiable. Keep in mind, that even though the property is sold as-is, the seller is still oblgied to make all disclosures, and the buyer still retains their contingency rights which remain in effect until the contingencies are removed in writing.” -CAR Legal 🏚️
