A quick one for California families. One of these is the signed order that authorizes the prison term. The other is just a clerk's summary. Most people are never told which is which — vote below.

In 2020, the head of California's prison system said something the record never walked back.

Without One Plea has documented that then–CDCR Secretary Ralph Diaz acknowledged the Department has no authority to hold a person without a Judgment of Conviction. That acknowledgment still stands on the record. His successors have continued the same custody on the same paperwork.

This is one of dozens of documents in our free library. Save this post so you can find it again.

An “Abstract of Judgment” is not a judgment. California’s own courts have said so. The Abstract is a summary form a clerk fills out. The
Judgment of Conviction is the signed order from the judge. They are different documents with different legal weight — “the Abstract of
Judgment is not the judgment of conviction.” (People v. Hartsell (1973) 34 Cal.App.3d 8.) An abstract isn’t signed by a judge. On its own, it can’t
authorize a prison term. This is the difference most families are never told about. Was it new to you? Let us know below.

One document turns a sentence into a lawful prison term. In file after file we’ve reviewed, it isn’t there. When a person is convicted, California
law requires the sentencing judge to sign a Judgment of Conviction, and the clerk to enter it in the court’s record. Until it’s entered, “no
judgment is effectual for any purpose.” (Pen. Code §1207; Code Civ. Proc. §664.) Minute orders, transcripts, and abstracts get filed. But the one
document the law actually requires the judge to sign — the judgment itself — often was never created. Part 2 of 7. Does your loved one’s file
contain a signed Judgment of Conviction — or only an Abstract? Tell us below.

A California felony case can begin only two ways. Most of the files we’ve reviewed began a third way.
Under California law, a felony prosecution must start with a grand jury indictment, or an “information” filed after a preliminary hearing. A felony complaint is neither — it’s a lower-level charging document. Without an indictment or information of record, the superior court never gets the authority to try the case. (Cal. Const. Art. I §14; Pen. Code §§737, 949.)
That’s link one in what we call the Chain of Failure.
Part 1 of 7. We’re walking through every step where the system was required to stop — and didn’t. Follow the page so you don’t miss the next one.

Monday, Monday... a great way to spend one-seventh of your life! ... if you know your purpose and are moving to fulfil it. W*P knows its purpose ... to educate the prison population that they may be illegally confined. Only when you know the truth can it set you free.
W*P has a plan and uses a commercial process to hold the state and responsible public employees accountable... since they are not immune for false imprisonment. And thereby effect release and compensation for W*P clients.

"Only one life, twill soon be past, only what's done for Christ will last" pinned to the sun-visor of my grandfather's 1935 Plymouth... and found to be true over my life experience. Analogous to W*P's goal ... to work as unto the Lord ... and redeem the time. People who are unlawfully confined, many of them LW*P and calling on God for help, are depending on W*P to timely prepare their case for release. W*P appreciates and requests your prayers in this matter.
