Suffering a work-related injury can be overwhelming, and understanding whether you qualify for workers’ compensation shouldn’t add to your stress.

In most cases, full-time, part-time, temporary, and seasonal employees are covered under their employer’s policy. However, independent contractors, consultants, and gig workers typically are not.

One way to determine eligibility is by reviewing how you are classified for tax purposes:

✅ If you receive a W-2, you likely qualify.
❌ If you receive a 1099 and taxes aren’t withheld, you are generally considered an independent contractor and may not be covered.

That said, misclassification is more common than many realize. If you believe you should be eligible for workers’ compensation but have been told otherwise, it may be worth exploring further.
