Senior Partner George Muscato was the recipient of the 2021 Alpha Delta Integrity Award, which was presented at the Niagara County Law Day awards ceremony last week.

This award is given to an attorney that demonstrates a high degree of integrity in the practice of law. We could not agree more.

2nd Amendment Win!

George Muscato obtained a dismissal of all charges for his client initially charged with illegal possession of fi****ms, silencers and dangerous instruments.

An investigation led by local law enforcement, ATF and USPS misfired when a search warrant was obtained on the erroneous claim that our client possessed silencers illegal in NYS. What he actually possessed were grease traps used in the cleaning of fi****ms. Grease traps can be converted into silencers.

The Court said that without conversion to a silencer, the mere possession of grease traps is not illegal. All charges DISMISSED.

Way to go, George!

Senior Partner George V.C. Muscato and attorney Amy Taylor represented a client accused of Attempted Murder. At trial they argued the evidence was insufficient to support an attempted murder conviction. The jury convicted their client, but Muscato and Taylor preserved the legal issue for appeal. Appellate attorney Robert Graff argued the appeal, and the Court of Appeals recently agreed with Muscato and Taylor's defense strategy.

"The People’s evidence in this case was insufficient to support defendant’s convictions for attempted murder in the first and second degrees because it failed to prove that defendant and his feigned confederate took any actual step toward accomplishing
defendant’s plan to kill his wife and mother-in-law beyond mere conversations and planning. Accordingly, we affirm."

Senior Partner George V.C. Muscato won the dismissal of a two-count Felony indictment in Allegany County. The Court agreed with Muscato's motion and dismissed the indictment on two separate grounds. First, the client's recent acquittal on similar charges in Wyoming County after trial (also handled by Muscato) resulted in collateral estoppel of any future charges against the client stemming from the same fact pattern. Second, even if it was permissible to present those charges in a separate county, the evidence presented was insufficient to support the charges.

Aggressive defense representation by attorney Muscato resulted in a full and complete acquittal for the client in both counties.

Not Guilty! Partner George Muscato, Esq. represented Kevin Lupiani on a single count indictment in Orleans County Court that carried up to four years of imprisonment. Mr. Muscato advocated on Mr. Lupiani's behalf this week during a multi-day jury trial. The jury deliberated on a single count of Criminally Negligent Homicide and unanimously acquitted Mr. Lupiani of any criminal liability.

Mr. Lupiani's family credited Mr. Muscato's success to his attention to detail and willingness to ask tough questions about how the investigation was handled.

Not Guilty On All Counts!

After a multi-day trial in Wyoming County, senior partner George V.C. Muscato, Esq. secured an acquittal for his client who faced up to 25 years in state prison. The indictment charged serious felonies, including two counts of Criminal S*x Act First Degree (B Felony) and one count each of R**e First Degree (B Felony), Coercion First Degree (D Felony), and Coercion Second Degree (A Misdemeanor).
