Hopefully your family inheritance comes with a little less drama than 𝑌𝑒𝑙𝑙𝑜𝑤𝑠𝑡𝑜𝑛𝑒. 😆

But if your plan for the family ranch is basically, “Leave it to the kids and let them figure it out,” you may be setting them up for some unnecessary drama of their own.

Here’s something a lot of people don’t realize: 𝒚𝒐𝒖 𝒄𝒂𝒏 𝒎𝒂𝒌𝒆 𝒔𝒐𝒎𝒆 𝒐𝒇 𝒕𝒉𝒐𝒔𝒆 𝒅𝒆𝒄𝒊𝒔𝒊𝒐𝒏𝒔 𝒏𝒐𝒘.

Depending on your family and your goals, a trust or family land LLC can establish rules for things like management, decision-making, valuation, and what happens when one family member wants out.

In other words, your kids don't necessarily have to invent the rules after they inherit the property.

If keeping the ranch in the family matters to you, let's make sure your Legacy Plan includes a plan for the ranch, too. 🤠

Dad thought he was doing the fair thing: leave the property equally to both of his kids.

But after he’s gone, one wants to keep it in the family. The other wants to sell and take their share in cash.

Neither one is wrong. They just want very different things from the same inheritance.

Here’s the part families may not realize: one sibling generally can’t stop the other from seeking a partition just by refusing to sell. A co-owner can ask a Texas court to end the shared ownership. If the property can be fairly divided, the court may divide it between the owners. If a fair physical division isn’t possible, the court may order the property sold and divide the proceeds according to each owner’s interest.

Suddenly, “just split it 50/50” doesn’t sound quite so simple.

When real estate is part of your estate, it’s worth thinking beyond who gets what percentage. Would either child actually want the property? Could one afford to buy the other out? Could other assets balance the inheritance? What happens if they simply can’t agree?

A little planning while the decisions are still yours to make can save your kids from having to make some very difficult ones later. ❤️
