WHAT IS A DIVORCE EXPERT?

What counts as an “expert” depends heavily on context.

In some fields, the word “expert” has a specialized meaning indicating a type of certification or training, often overseen by a professional authority, such as a state board of medical examiners or a bar association.

In more ordinary usage, “expert” simply means someone who has substantial familiarity with a particular subject matter or type of activity.

The range of experts in this sense who may be called on in the course of a divorce is wide, but two we often work with at Colorado Divorce Law Group are certified divorce financial analysts (CDFAs) and child counselors or therapists.

Call our office today to discuss the potential need for specialized expertise in your own case.

CRYPTOCURRENCY INVESTMENTS IN HIGH NET WORTH DIVORCE

Cryptocurrency has quickly become a popular investment strategy for some, and can often factor into property division in a high net worth divorce.

Generally, crypto is treated similarly to a retirement account, in that it is valued by a professional and from there may be distributed via agreement between the spouses or in accordance with a decision by the court.

That said, there can be a number of factors that affect how cryptocurrency investments are handled in a specific case, so you may want to speak with a member of our Littleton divorce team if you are approaching a high net worth divorce with substantial digital assets.

WILL A DRUG RELAPSE COST YOU CUSTODY OF YOUR CHILD?

Revocation of parenting time rights is possible due to a drug relapse, but this is not the only possible outcome of substance abuse on a child custody agreement.

Substance abuse can affect both the addicted parent’s parenting time but also their decision-making power in the child’s life.

A drug relapse could mean that the parent has less authority over decisions in the child’s life.

The addicted parent could also see their parenting time reduced, or temporarily reduced, on the condition that they work towards sobriety.

Call our Denver child custody lawyer to discuss the specifics of your own situation.

Real Estate Questions Common In High Net Worth Divorces

The Denver metro area sees divorces in every income range.

Having adequate resources on hand to cover expenses can make some aspects of divorce easier, but in the context of high net worth divorces the otherwise fortunate circumstance of owning valuable property can sometimes lead to real estate questions that are less common in other families.

Many of these questions turn on issues of home ownership in the division of marital assets, but it is not unusual for Littleton residents going through high net divorces to find themselves actively shopping for a new home while their divorce is pending.

TIPS FOR NEGOTIATING A SOLID PRENUP

During negotiations of all types, the goal should be for both parties to walk away feeling satisfied.

Although spouses often try to “win” when fighting in court, private negotiations generally should be more collaborative and cooperative.

Not only is a combative approach less likely to succeed during negotiations around prenuptial agreements, but it may also lead to a contract that the courts will not uphold.

A member of the experienced family law team at our Littleton office may be able to assist you in planning your prenuptial agreement.

Balancing Second Chances With Safety: The Legal Reality Of Addiction Recovery

Substance use disorder is a significant issue in many Colorado families.

When these families begin to break apart, the issue of addiction can affect custody in complex ways.

Some parents understand that their addiction recovery could potentially impact the amount of time they have with their kids after a divorce or breakup.

On the other hand, a non-addicted parent might be concerned with the safety of their children when they visit the other, addicted parent.

Click the link to learn more about the intersection of addiction recovery and child custody in this week’s all-new blog from our Denver child custody team.

WILL YOU HAVE TO ATTEND MEDIATION IN A DENVER FAMILY LAW CASE?

If you are a parent filing for divorce in the Denver area, you will usually be required to attend mediation services to negotiate an allocation of parental responsibilities.

Post-decree modifications involving proposed changes to the parenting schedule are also typically referred to mediation, unless the petition to modify is submitted jointly.

In divorces without children, mediation may still be required if you are unable to reach an agreement with your partner independently, but because child custody decisions tend to be among the most emotionally fraught, many couples find it easier to resolve their differences when the time they get to spend with their children is not at stake.

One of our family law attorneys may be able to answer your questions about mediation in a private consultation.
