Barker, Gelfand, James & Sarvas, P.C. is a Southern New Jersey law firm handling various types of civil litigation and administrative matters. We have offices in Linwood, Pitman, and Marlton and our litigation practice focusses mainly on employment and municipal matters.

Role Description

This is a flexible role, with preference for a full-time hybrid role for an Attorney, primarily based in Marlton, NJ, with the possibility of some work from home and/or our other offices. The Attorney will be responsible for handling civil litigation and administrative matters, providing legal advice, conducting research, and engaging in settlement negotiation. The Attorney will work on cases related to employment and labor law, as well as other legal disputes.

Qualifications

Prior exposure to Labor and Employment Law a plus
Ability to provide Legal Advice and conduct thorough Research
Excellent written and verbal communication skills
Ability to work both independently and as part of a team
Juris Doctor (JD) degree from an accredited law school
Prior experience in civil litigation, defense especially is a plus

On July 6, 2023, Judge Kirsch of the United States District Court for the District of New Jersey decided an interesting case, Elfar v. Holmdel, and ruled that the defendant officers and the defendant municipality in a Federal Civil Rights case, were not bound by the rulings and findings of the municipal court prosecution, for example as to the ultimate finding of lack of probable cause for the search of a motor vehicle during a motor vehicle stop in a ma*****na DWI case. At its core, the decision was based upon Judge Kirsch’s view that the officers, and Holmdel, did not have sufficient control over the prosecution of municipal court case and the appeal to Superior Court in that case, so they should not be stuck with the results from that matter in the Federal Civil rights case. Therefore Judge Kirsch ruled and, as such, the town and the officers could relitigate issues in the civil rights case which had been decided against the town and the officer during the municipal court prosecution and appeal.

The case has potential value for the defense in civil rights cases following an unsuccessful municipal court prosecution, which often times triggers a civil rights lawsuit by the successful municipal court defendant.
