AI continues to treat us to novel surprises. In a recent case, a plaintiff was sanctioned for using a prompt injection in a court filing. The plaintiff embedded tiny white-on-white text in the document which was virtually invisible to the human eye but readable by AI systems reviewing the filing. The hidden text was designed to manipulate the AI into reaching a conclusion favorable to his position.

Well, it’s better than finding out the truth for the first time during trial. My poker face has gotten a LOT of practice over the years. At this point, it deserves its own bar card.

My posts have showcased the beautiful architecture of Nebraska’s courthouses, along with the remarkable artwork found within them. But if you haven’t yet visited our State Capitol, I encourage you to make the trip and experience it for yourself.

I have been privileged to argue cases before both the Nebraska Supreme Court and the Nebraska Court of Appeals, whose beautiful courtrooms are located within this remarkable building. Our courthouses are more than places where the law is argued and decided—they are works of art in their own right.

Happy 89th Birthday to Senator Ernie Chambers. There is a Japanese saying that "The nail that sticks up gets hammered down." Ernie Chambers spent his political life in Nebraska being the nail, but rather than being hammered down, Ernie Chambers wore down the hammers. Fun fact - he graduated from Creighton Law School, but never became a licensed attorney because he refused to join the Nebraska State Bar Association on the grounds that his graduation from law school should grant him the right to practice law.

New at Flatwater: After a 1955 Lincoln homicide investigation popularized the Reid Technique, it dominated the next 70 years of interrogations in the U.S. and beyond.

In interviews with the Flatwater Free Press, law enforcement groups in Nebraska defended using it as an effective tool. But there’s also growing evidence that the famed technique can prompt false confessions from innocent people.

Interpreters provide a vital role in making sure everyone has access to our justice system. These folks are highly skilled and provide a service that is difficult to appreciate until you try it yourself. We humans speak rapidly, start and restart sentences, use idioms, and blend words together without thinking about how someone might try to interpret those words to another. Interpreting is as much an "art" as it is a "science." Here is a photo of some talented folks who recently attended the Second Annual Interpreter's Conference at Boys Town.

I'm happy to see Nebraska continue to expand its problem solving courts. As an attorney practicing in both the Lancaster County Family Treatment Court and the Lancaster County Safe and Healthy Families Court, I see the direct benefits to families and our community fostered by these courts. Problem solving courts are specialized courts that address specific issues such as addiction, mental illness, or domestic violence. Statistics show these courts are producing better results for families. The courts hold people accountable while treating the addiction that brings individuals into the justice system through an approach that is less adversarial and more collaborative than a standard court docket.

In a ceremony in the Nebraska Supreme Court Courtroom, Chief Justice Jeffrey Funke held a proclamation signing ceremony on behalf of the Nebraska Judicial Branch on Monday, May 4 at 1:30 p.m. The ceremony was streamed live and is available for viewing.
